Common use of Variation of Period of Maternity Leave Clause in Contracts

Variation of Period of Maternity Leave. (a) Provided the maximum period of maternity leave does not exceed the period to which the employee is entitled under clause 2.1.3: (i) the period of maternity leave may be lengthened once only by the employee giving not less than 14 days' notice in writing stating the period by which the leave is to be lengthened; (ii) the period may be further lengthened by agreement between the employer and the employee. (b) The period of maternity leave may, with the consent of the employer, be shortened by the employee giving not less than 14 days notice in writing stating the period by which the leave is to be shortened. (c) An employee and an employer may agree that the employee break the period of maternity leave by returning to work for the employer, whether on a full-time, part-time or casual basis.
