The Vessel Strike Avoidance Measures clause establishes requirements for vessels to take specific actions to prevent collisions with marine animals, particularly protected species such as whales. Vessel Strike Avoidance Measures. 4.2.1 The Lessee must ensure that all vessels conducting activities in support of plan submittal, including those transiting to and from local ports and the lease area, comply with the vessel-strike avoidance measures specified in Section 4.2, except under extraordinary circumstances when complying with these requirements would put the safety of the vessel or crew at risk.
Vessel Strike Avoidance Measures. Lessee must ensure that all vessels conducting activity in support of Plan submittal comply with the vessel-strike avoidance measures specified in stipulations 7.4.1. through 7.4.8., except under extraordinary circumstances when the safety of the vessel or crew are in doubt or the safety of life at sea is in question.
7.4.1. Lessee must ensure that vessel operators and crews maintain a vigilant watch for cetaceans, pinnipeds, smalltooth sawfish and sea turtles and slow down or stop their vessel to avoid striking these protected species.
7.4.2. Lessee must ensure that all vessel operators comply with 10 knot (18.5 km/hr) speed restrictions in any Dynamic Management Area (DMA). In addition, Lessee must ensure that vessels 65 ft (20 m) in length or greater, operating from November 1 through July 31, operate at speeds of 10 knots (18.5 km/hr) or less.

5.2.3 The Lessee must ensure that vessels 19.8 meters (65 feet [ft]) in length or greater, operating from November 1 through April 30, operate at speeds of 10 knots (18.5 km/hr) or less.
5.2.4 The Lessee must ensure that all vessels operating in any mid-Atlantic Seasonal Management Area (SMA) from November 1 through April 30 operate at speeds of 10 knots (18.5 km/hr) or less.
5.2.5 The Lessee must ensure that all vessel operators comply with 10 knot (18.5 km/hr) speed restrictions in any Dynamic Management Area (DMA).
5.2.6 The Lessee must ensure that vessel operators monitor the North Atlantic Right Whale Reporting Systems (e.g., the Early Warning System, Sighting Advisory System, and Mandatory Ship Reporting System) from November 1 through July 31 for the presence of North Atlantic right whales during activities conducted in support of plan submittal.
