Wage Rates and Additional Compensation. 9.2.1 Nurses covered by this Agreement shall be compensated at the wage rates set forth in Appendix A hereto. 9.2.2 This contract should not be construed to limit the Agency’s right to reward an individual nurse’s performance over and above the prescribed conditions called for in this Agreement. The Association further acknowledges that the Agency has the right to compensate nurses over and above the amounts set forth in this Agreement in response to needs for limited periods of time. The Agency agrees to notify the Association of all new pay enhancement plans prior to implementation. The Agency further agrees to consider prior to implementation all reasonable objections, suggestions and/or concerns raised by the Association within five (5) calendar days after such notification. At the time of implementation of the plan, the Agency shall provide terms, including criteria, of the plan to the Association. a. In the event the Agency activates a pay enhancement plan for specific time periods in specific programs, then regardless of when during the work cycle the commitment to perform additional work has occurred, all nurses who meet the criteria for such additional compensation during the specified time period in the specified program(s) shall be entitled thereto. b. The Agency shall provide notice to all nurses within the affected program of the activation of an intermittent pay enhancement plan as soon as a determination of its availability is known. Such notice may be actual or constructive. The intent of this provision is to provide notice of the terms of the plan to such eligible nurses. 9.2.3 The Agency agrees that it may not unilaterally establish, without first bargaining with the Association (either to agreement or to impasse), a system of compensation that is not time-limited. In the event that an agreement is reached, it shall be considered part of this Agreement for the duration of the Agreement.

The Agency Medical Center shall provide notice to all nurses within the affected program nursing unit and shift of the activation of an intermittent pay enhancement plan as soon as a determination of its availability is known. Such notice may be actual or constructive. The intent of this provision is to provide notice of the terms of the plan to such eligible nurses. 9.2.3 c. The Agency agrees that it may not unilaterally establish, without first bargaining with existing Critical Staffing Incentive (CSI) Program and the On- Call/Called-In (OCCI) Plan will continue in effect until the Medical Center provides to the Association and bargaining unit nurses written notice of discontinuation of either plan. This notice will be given a minimum of one (either 1) full posted work cycle in advance of discontinuation.
