WAGES AND RATES OF PAY. 7.01 Wage schedules applicable to various job classifications are as set forth on Schedule "A" attached hereto and made part hereof. WAGES AND RATES OF PAY. 7.01 Section 1. Wage schedules rates for Tier I employees are listed in Appendix A. Tier I rates apply to employees hired before August 10, 2002. Wage rates for Tier II employees are listed in Appendix B. Tier II rates apply to employees hired August 10, 2002 and after.
Section 2. New employees without previous experience will be hired at the appropriate rate as shown on the progression rate scales outlined in Appendix “B” of this Agreement. The first step of the four steps on the Progression Scale will not apply to employees bidding to another labor grade. The four-step Progression Scale will only apply to new employees hired after July 22, 1978
Section 3. Employees who have some experience will be placed at a rate on the progression rate scale commensurate with their experience and ability to perform the job between the minimum hiring rate for the labor grade up to and including the full job rate if the employee is fully qualified. In no case shall any employee receive less than his present rate when he is accepted for training on another job provided the move is lateral or up.
Section 4. Any employee on a progression rate shall be reviewed periodically and appropriate adjustments shall be made on the basis of the review period until the employee reaches the full rate of the job. Employees in all labor grades shall be reviewed a minimum of every thirty- (30) days and progressive adjustments will be granted provided the employee demonstrates appropriate progression in skill, ability and performance on the job.
Section 5. Employees working on a scheduled second shift shall be paid a night shift premium of $.25 per hour. Employees working on a scheduled third shift shall be paid a night shift premium of $0.27 per hour. Employees assigned to one shift shall not receive a premium applicable to various another shift for any reason.
Section 6. Any employee on transfer to another job classifications are as set forth on Schedule "A" attached hereto and made part hereofshall be paid the rate of his/her job or the rate of the job to which he/she is transferred, whichever is higher. An incentive employee will be paid five (5) labor grades higher than his/her base rate in those cases where the job to which he/she is transferred causes a loss of earnings. Temporary transfers will not exceed ninety (90) days in a year unless otherwise agreed to. If a transfer exceeds ninety (90) days, the job will be posted. The wages shall apply Company may temporarily transfer an incentive employee to all work performed another job based on skill and ability in cases of absence and vacation and to expedite work. If the constructiontransferred employee is the non-junior employee, erectionthe employee will be paid average hourly earnings up to 120% of base rate. If the transfer exceeds 30 continuous days, repairthen the employee will be paid average his/her hourly earnings thereafter. In addition, remodelling or alteration of a building or structurethe Company may temporarily transfer an employee to another department to train another employee, in whole or in part, which shall case the transferred employee will be or is being used for commercial, industrial or institutional purposespaid average earned rate from the last full week worked.

7.04 Wages a. Two (2) hours will be paid where, upon arrival to the site, the job is shut down and the employee is sent home due to poor weather conditions. Where the employee is instructed to wait, the minimum daily pay applies. In the event of inclement weather this payment shall not be made if such inclemency was prevalent at the time the employee left his home to report for work.
b. The Employer agrees to pay the employee four (4) hours at his basic hourly rate when the employee commences work and the work is suspended provided that the employee remains on the job if requested by the Employer.
c. On scheduled night shift highway maintenance, minimum shift pay is eight (8) hours, provided at least four (4) hours are worked. (Highway maintenance is defined as any work on controlled access roadways where there is low tolerance for inclement weather due to high rates of speed on those roadways.
d. These minimum payments shall not be deemed to cover travel time or expenses unless identified elsewhere in the contract.
7.05 When, due to inclement weather, the work has to be stopped, the Employer agrees to continue payment of a regular hourly rate until the xxxxxxx on the job advises the men to go home.
7.06 When there is temporarily not sufficient work in a specified classification, the Employer has the option of employing affected employees in another classification at the rate of pay of their usual classification.
7.07 Where an employee covered by this Collective Agreement is predominantly welding and has his ticket, it will be his responsibility to ensure the job xxxxxxx indicates welder rate on the daily time sheet, and the Employer will pay the welder rate for that day.
7.08 The employees shall be paid weekly, within five (5) calendar days by the Friday following the end of the pay period, by cheque or direct deposit and shall be accompanied by a separate statement identifying both . Monday is the Employer and employee, outlining regular hours worked, first day of the hourly rate, overtime hours worked, overtime hours banked, the total earnings, amounts of deductions, net earnings and contributions to the Unions Health Fund and Pension Fundpay period.

a. Where the Employer is a sub-contractor: The employee in charge of a job for which the estimated time and piping material costs is greater than fifty thousand dollars ($50,000) involved. Failure to reach agreement shall be subjected to the Grievance Procedure.
7.04 Wages shall be paid weekly, within five a responsibility premium as follows: two percent (52%) calendar days following the end of the pay period, project‟s time and piping costs – both relating only to time spent by cheque or direct deposit and piping material used by employees of the Employer. The premium amount shall be calculated and disclosed in advance of the project and shall be accompanied by paid out monthly in even instalments until such time as the premium is exhausted. Upon project completion any premium balance is paid out on the next pay cheque. The premium will be paid on a separate statement identifying both cheque subject to the statutory deductions based on that amount. Where responsibility for multiple jobs underway that are under the fifty thousand dollars ($50,000) threshold is undertaken, the employee may bring that to the attention of the Employer. They will then meet to determine if a responsibility adjustment is warranted and agreeable. Underway begins with employee receipt of blue prints and ends with employee receipt of the deficiency list.
b. Where the Employer is a general contractor: The formula shall be three-quarter percent (0.75%) of the subcontractors‟ bid prices, plus the formula above, but calculated at one and employee, outlining regular hours workedone-half percent (1.5%). There is no minimum project value for projects where the Employer is the General Contractor.
c. In any case where a responsibility premium is payable, the hourly rateresponsibility premium generated by time and material work or the project shall be calculated on the job close-out sheet, overtime hours worked, overtime hours banked, the total earnings, amounts of deductions, net earnings and contributions which shall be copied to the Unions Health Fund Employer.
d. Any dispute over who is entitled to the premium shall be referred to a joint meeting of Employer representatives and Pension FundUnion representatives.
7.05 New Journeymen (i.e. upon hire or upon attaining Certificate of Qualification) may be paid eight-five percent (85%) of the Journeyman rate subject to the following conditions:
a. Maximum of six (6) months from original date of hire or from attaining Certificate of Qualification, as the case may be. Upon six (6) months worked a three (3) month extension, only where agreed in writing by Employer, worker, and Union, may be implemented.
b. Responsibility for projects larger than five hundred thousand dollars ($500,000) or four (4) workers trigger regular Journeyman rate.
c. Employees hired in their fourth year or earlier who complete their apprenticeship with the Employer shall be paid the regular journeyman rate upon obtaining their Certificate of Qualification. Employees hired in their fifth year of apprenticeship upon obtaining their Certificate of Qualification may be paid eighty-five percent (85%) of the Journeyman rate for a maximum of four (4) months from attaining the Certificate of Qualification, with a review at that four (4) months.

For these purposes hours off work on banked overtime, statutory holidays, earned vacation and/or paid sick days shall be counted as hours worked for the purpose of determining said thirty-five (35) straight-time hours.
ii) Processing and Labour Employees - Hours worked as General Help shall count to determine the applicable General Help pay rate; hours worked as Forklift shall count to determine the applicable Forklift pay rate.
b) The following employees shall receive a one-time lump sum payment as provided below, less applicable deductions. When the weather does not permit employees to start work at the regular starting time and the superintendent decides to send the employees home, any employee who has reported for work will be compensated with one hour of his regular pay, unless he was notified beforehand by his Employer not to report for workholiday.
7.03 7.02 Where a new classification is created, the Union will be notified and negotiations commenced to determine the wage rate to be paid to the employee(sEmployee(s) involved. Failure to reach agreement shall be subjected to the Grievance Procedure.
7.03 If an employee who regularly works more than three (3) hours a day is required to present himself or herself for work but works less than three (3) hours, despite being available to work longer, the employer shall pay the employee wages equal to the employee’s regular rate for three (3) hours of work. This shall not apply if the Employer is unable to provide work for the employee because of fire, lightning, power failure, storms or similar causes beyond the Employer’s control that result in the stopping of work. The circumstances must be responsible for the complete stoppage of an employee’s work. If the circumstances only reduce the demand for the employee’s services, the three (3) hour rule will apply.
7.04 Wages Responsibility premium shall be paid weekly, within to the employee primarily responsible for the full time on site supervision including:
a. Where the Employer is a sub-contractor: The employee in charge of a job for which the estimated time and piping material costs is greater than seventy-five thousand dollars (5$75,000) calendar days following the end shall be paid a responsibility premium as follows: two percent (2%) of the pay periodproject’s time and piping costs – both relating only to time spent by and piping material used by employees of the Employer. The formula shall be a quarter percent (0.25%) of the subcontractors’ bid prices, by cheque or direct deposit plus the formula above. The premium amount shall be calculated and disclosed in advance of the project and shall be accompanied by paid out monthly in even instalments until such time as the premium is exhausted. Upon project completion any premium balance is paid out on the next pay cheque. The premium will be paid on a separate statement identifying both cheque subject to the statutory deductions based on that amount. Where responsibility for a job that is estimated to require a minimum of two hundred (200) man hours, there will be a two dollar ($2.00) per hour premium paid. The Employer and employee will then meet to determine if a responsibility adjustment is warranted and agreeable. Underway begins with employee receipt of blue prints and ends with employee receipt of the deficiency list.
b. Where the Employer is a general contractor: The formula shall be three-quarter percent (0.75%) of the subcontractors’ bid prices, plus the formula above, but calculated at one and employee, outlining regular hours workedone-half percent (1.5%). There is no minimum project value for projects where the Employer is the General Contractor.
c. In any case where a responsibility premium is payable, the hourly rateresponsibility premium generated by time and material work or the project shall be calculated on the job close-out sheet, overtime hours worked, overtime hours banked, the total earnings, amounts of deductions, net earnings and contributions which shall be copied to the Unions Health Fund Employer.
d. Any dispute over who is entitled to the premium shall be referred to a joint meeting of Employer representatives and Pension FundUnion representatives.
7.05 New Journeymen (i.e. upon hire or upon attaining Certificate of Qualification) may be paid eight-five percent (85%) of the Journeyman rate subject to the following conditions:
a. Maximum of six (6) months from original date of hire or from attaining Certificate of Qualification, as the case may be. Upon six (6) months worked a three (3) month extension, only where agreed in writing by Employer, worker, and Union, may be implemented.
b. Responsibility for projects larger than five hundred thousand dollars ($500,000) or four (4) workers trigger regular Journeyman rate.
c. Employees hired in their fourth year or earlier who complete their apprenticeship with the Employer shall be paid the regular journeyman rate upon obtaining their Certificate of Qualification. Employees hired in their fifth year of apprenticeship upon obtaining their Certificate of Qualification may be paid eighty-five percent (85%) of the Journeyman rate for a maximum of four (4) months from attaining the Certificate of Qualification, with a review at that four (4) months.

7.05 Employees operating a stone conveyor equipped ready-mix truck will be paid weeklya premium of ten dollars ($10.00) per load for all concrete or stone placed over the conveyor. It is further agreed that should a customer request conveyor service, within five (5) calendar days following the end a conveyor operator may be called in to meet that request regardless of that operator's seniority. In such an instance, payment will not be made to senior Ready Mix Truck Operators for any hours a junior conveyor operator may have worked in advance of such senior Ready Mix Truck Operators. It is understood that this compensation is in recognition of the pay period, by cheque or direct deposit extra daily maintenance and shall be accompanied by a separate statement identifying both the Employer and employee, outlining regular hours worked, the hourly rate, overtime hours worked, overtime hours banked, the total earnings, amounts of deductions, net earnings and contributions cleaning procedures necessary to the Unions Health Fund and Pension Fundproper operation of the truck mounted conveyor. 8.03 Drivers shall be paid for all driving according to the agreed upon mileage, trip, or hourly rate, as applicable. Trips beyond a radius of payone hundred (100) miles will be covered by the line haul provisions described herein. In such casesMileage shall be based on the most direct, employees legal truck route.
8.04 Company drivers shall make reasonable efforts be paid semi-monthly for all wages earned to contact their supervisor by phone or text to determine whether their shift is cancelled due to weather a day not more than sixteen (16) days prior to the beginning day of payment. WAGES AND RATES OF PAY. 7.01 8.01 Wage schedules applicable to various job classifications are as set forth in Schedule “A”.
8.02 Prior to the annual wage increase there shall be a meeting held between the Union and the Employer to review the classifications of all employees to determine if they are properly classified according to their abilities and the jobs they perform. Employees when eligible may be reclassified prior to the annual wage increases.
8.03 Additional classifications may be established only by mutual agreement between the Employer and the Union during the term of this Agreement, and the rates for same shall be subject to negotiation between the Employer and the Union. Failure to reach agreement shall be subject to the Grievance and Arbitration Procedure, outlined herein.
8.04 Employees shall be paid not less frequently than on Schedule "A" attached hereto a bi-weekly basis, all wages earned by such employees to a day not more than seven (7) days prior to the day of payment. Payment of wages will be made by direct deposit into the employee’s pre-arranged bank accounts on the designated paydays. WAGES AND RATES OF PAY. 7.01 Wage schedules applicable to various job classifications The wage rates for each classification of employees covered by this Agreement are those in existence as of the effective date of this Agreement and are set forth in Appendix I.
Section 1. Effective February 9, 2001, a wage increase shall be provided to all employees covered by this Agreement in the classifications set forth herein.
Section 2. Payroll checks will be issued weekly on Schedule "A" attached hereto and made part hereofThursdays unless the Company determines to change payday to Fridays. If such change in payday is made, the Company shall notify the Union five (5) working days in advance of such change. If payday is changed to Fridays, any employees working on 4/10 hour shifts or night shifts shall receive their paychecks on Thursdays. The wages stubs of paychecks due to Employees will show separately the number of straight time and overtime hours worked and paid and vacation hours available.
Section 3. If at any time during the life of this Agreement a new bargaining unit job is created which is not specifically covered by this Agreement and for which no wage rate has been specifically provided by this Agreement, the Company shall apply establish the rate to all work performed in be paid for the construction, erection, repair, remodelling or alteration of a building or structure, in whole or in part, which new job. Such new position shall be or is posted and a copy provided to the Union seven (7) days prior to the position being used for commercial, industrial or institutional purposes.
7.02 An employee who is sent home from work before he has worked three (3) hours, shall receive a minimum of three (3) hours pay at filled. Such new job may be filled by the Company as it deems necessary. If the Union disagrees with the rate of pay he would have earned if established for the work had been performed. Section 4. All job openings, employees as far as practicable, shall make reasonable efforts be posted as soon as possible in order to contact their supervisor by phone allow interested parties to apply.
Section 5. The Company has established for its bargaining unit Employees incentive bonus programs entitled the Project Bonus Program and the Hourly Bonus Program. The Company reserves the right to change, modify, or text discontinue these bonus programs at its sole discretion.
Section 6. It is recognized that from time to determine whether their shift is cancelled due to weather prior to time market conditions may be such that the beginning Company may experience problems retaining and/or attracting qualified Employees in the various skilled classifications. When this happens, at the request of the work day. If they do not, they will not be entitled to show up time. Employees must inform the Employer of a means of being contacted on short notice. WAGES AND RATES OF PAY. 7.01 Wage Piece work wage schedules applicable to various job classifications are as set forth on Schedule "A" attached hereto and made part hereof. The wages shall apply to all work performed in the construction, erection, repair, remodelling or alteration of a building or structure, in whole or in part, which shall be or is being used for commercial, industrial or institutional purposes.
7.02 An employee who is sent home from Hourly wage rates are determined by average hourly piece work before he has worked three earnings calculated in the prior six (36) hours, shall receive a minimum of three (3) hours pay month period as calculated at June 30 and December 31 annually; such hourly rates are not less than the rate of pay he would have earned if the work had been performed. In the case that inclement or stormy weather causes current hourly rates paid for hourly work to stop or prevents work from starting, employees who report for work shall receive a minimum pay of three (3) hours pay at their regular rate of pay. In such cases, employees shall make reasonable efforts to contact their supervisor by phone or text to determine whether their shift is cancelled due to weather prior to the beginning of the work day. If they do not, they will not be entitled to show up time. Employees must inform the Employer of a means of being contacted on short notice. If the Employer so attempts to inform the employee of a lack of work due to weather but is unable to do so, the employee will not be entitled to show up time. When the weather does not permit employees to start work at the regular starting time and the superintendent decides to send the employees home, any employee who has reported for work will be compensated with one hour of his regular pay, unless he was notified beforehand by his Employer not to report for workmember.
7.03 The hourly wage rates in 7.02 above shall increase, at a minimum, in accordance with the percentage increases in the piece work schedule.
7.04 Where a member obtains contractor status, he may invoice the Employer as often as weekly and at least monthly on a piece work or hourly basis in accordance with this Agreement.
7.05 Employer shall remit for each member, the amounts required by WSIB and Employer Health Tax, if EHT is currently paid by the Employer, or if it is a statutory requirement.
7.06 Where a new classification is created, the Union will be notified and negotiations commenced to determine the wage rate to be paid to the employee(smembers(s) involved. Failure to reach agreement shall be subjected to the Grievance Procedure.
7.04 Wages 7.07 A dispute over the application of the hourly schedule or piecework schedule shall be paid weeklynegotiated and referred to arbitration where, within five (5) calendar days following in the end opinion of either party, a reasonable resolution seems unobtainable. Normally pre-job meetings will set out those arrangements, in writing, in advance of the pay periodjob. Adjustments, by cheque thereafter, or direct deposit and during the course of the job shall be accompanied by a separate statement identifying both the in writing and indicate agreement between Employer and employee, outlining regular hours worked, the hourly rate, overtime hours worked, overtime hours banked, the total earnings, amounts of deductions, net earnings and contributions to the Unions Health Fund and Pension Fundmember.

7.04 Wages a. i. The Employer shall pay two (2) hours of wages in the event that the employee reports for work in the usual manner and is prevented from starting work due to any cause within the Employer’s control.
ii. Effective January 1, 2019, the Employer shall pay three (3) hours of wages in the event that the employee reports for work in the usual manner and is prevented from starting work due to any cause within the Employer’s control.
b. In the case of inclement weather:
i. the employee shall be paid weeklyobligated to call in to the Employer one (1) hour before coming to work;
ii. the Employee must receive direction from his xxxxxxx or supervisor prior to coming in to work;
iii. the regular starting and quitting times may be altered; and
iv. The Employer reserves the right to call its employees in to work if weather clears, within five providing a two (52) calendar days following hour notice is given to the end employee by the Employer, and provided that the amended start time is no later than 11 am on that day.”
7.04 When work has to be stopped due to inclement weather, the Employer shall continue payment of the regular hourly rate until the xxxxxxx on the job orders the employees to go home.
7.05 If the Employer bids on a job, the specifications of which call for the employment of some local labour or the paying of prevailing rates of pay periodor both, by cheque or direct deposit and shall be accompanied by a separate statement identifying both representatives of the owner of the project, of the Employer and employee, outlining regular hours worked, of the hourly rate, overtime hours worked, overtime hours banked, the total earnings, amounts of deductions, net earnings and contributions Union shall meet to make a decision in regard to the Unions Health Fund and Pension Fundemployment of such labour or in regard to the prevailing rates to be paid or both.
