Waiver of Requirements. Any of the requirements of this Agreement may be expressly waived by the County in writing, but no waiver by the County of any requirement of this Agreement extends to or affects any other provision of this Agreement, and may not be deemed to do so.
Waiver of Requirements. No requirement whatsoever of this Lease shall be deemed waived or varied, nor shall the Lessor's acceptance of any payment with knowledge of any default or of Lessor's failure or delay to take advantage of any default constitute a waiver of the Lessor's rights thereby nor of any subsequent or continued breach of any requirement of this Lease. All remedies herein provided for shall be in addition to, and not in substitution for, any remedies otherwise available to the Lessor.

Any of the requirements of this HOME/HOPWA Regulatory Agreement may be expressly waived by the County in writing, but no waiver by the County of any requirement of this HOME/HOPWA Regulatory Agreement extends to or affects any other provision of this HOME/HOPWA Regulatory Agreement, and may not be deemed to do so.
Waiver of Requirements. Notwithstanding anything in this Section 3 to the contrary, any of the terms of Subsections 3.1 through Subsection 3.3 may be waived, in whole or in part and as to particular transactions or matters or as to one or more members of the Trian Group, if (a) in the case of a waiver of an obligation of a member of the Trian Group, a majority of the Independent Directors shall have approved such waiver or (b) in the case of a waiver of an obligation of the Company provided for the benefit of a member of the Trian Group, such member of the Trian Group shall have consented in writing to such waiver.
Waiver of Requirements. Any of the requirements of this HOME Regulatory Agreement may be expressly waived by the County in writing, but no waiver by the County of any requirement of this HOME Regulatory Agreement extends to or affects any other provision of this HOME Regulatory Agreement, and may not be deemed to do so.
Waiver of Requirements. Each of the Parties hereby irrevocably waives any claim that the execution or consummation of any of the transactions effected pursuant to this Agreement violate or are prevented by any provision of such Party’s governing documents, including any limited liability company agreement, operating agreement, bylaws, or other similar governing document (including any provision that may purport to require any member or owner of such Party to offer such Party’s securities to any other person before transferring ownership of such securities).
Waiver of Requirements. Any waiver of any requirement contained in this Agreement shall be by mutual agreement of the parties hereto. Any waiver shall be reduced to writing and a copy of the waiver shall be provided to each Party. Failure to insist upon strict performance of any of the terms and conditions hereof, or failure or delay to exercise any rights provided herein or by law, shall not be deemed a waiver of any rights of any Party hereto.
Waiver of Requirements. When, in the judgment and upon approval of the Village Board after recommendation of the Village Planning Commission, it would be inappropriate to apply literally a provision of this Chapter because the subdivision is located outside the corporate limits or because extraordinary or undue hardship would result, it may waive or modify any such provisions so that substantial justice may be done and the public interest secured, provided that in no event shall the requirement of filing and recording the plat or survey be waived. Reasons for such waiver or modification shall be stated in the minutes of its meeting.
Waiver of Requirements. Normally, only employees who meet the qualification standards for the higher level position may be promoted. In extenuating circumstances, licensing and experience requirements may be waived by the respective Marine Operations Center (MOC) Commanding Officer (CO) with the endorsement of the CME in accordance with the provisions of Chapter I, Section IV of the Wage Marine Qualifications Standards Handbook. Where a waiver is issued that would span more than one project, a new waiver is required at the commencement of each project. The sum of all periods of temporary promotion(s) from the same position where a waiver(s) has been issued may not exceed 1 year. Exception: No Licensed Engineering Officers may be temporarily promoted to the position of Chief Engineer on a waiver.
Waiver of Requirements. Notwithstanding anything in this Section 3 to the contrary, any of the terms of Sections 3.10 through 3.9 may be waived, in whole or in part, and as to particular transactions or matters, if the Board of Directors of the affected Venture Partner shall have approved such waiver.
