White Labelling. If mutually agreed by the parties in writing, ASC shall brand the Services with Reseller-specific branding prior to making the Services available for re-sale by Reseller. The Services shall also be branded with “powered by ASC” marks and logos as the parties mutually agree. The Services shall in all cases retain any relevant patent, copyright and/or other intellectual property notices as may be determined to be appropriate by ASC. Reseller shall provide, in softcopy/electronic format as reasonably specified by ASC, the Reseller-specific branding to be used to white-label the Services. ASC shall provide Reseller with access to the white-labeled Services to review prior to making any production versions of the white- labeled Services commercially available for re-sale by Reseller. Reseller shall use commercially reasonable efforts to promptly review the white-labeled Services. The Reseller-specific branding will be applied to the Services by ASC for the fees specified in the applicable SOW for such Professional Services. ASC shall only use any Reseller-specific branding materials provided to ASC for the purposes of re-branding the Services as contemplated in this Section 3.3 and for the operation of the white-labeled Services. Except for the foregoing limited rights, Reseller shall retain all right, title and interest in the Reseller-specific branding provided to ASC.

White Labelling. The Partner may not white label the Products without the prior written consent of ReadiNow.
White Labelling. 4.1. This clause 4 shall apply if the Subscriber subscribes to the XxxxXxxx.xxx version which incorporates a white labelling function and shall be without prejudice to anything contained in the Subscriber Agreement, this Addendum, or the Website Terms of Use.
White Labelling. 5.1. The XxxxXxxx.xxx version which incorporates a white labelling function shall enable the Subscriber to customise certain content on XxxxXxxx.xxx through administrative tools. The only customisation available and permitted to be made by the Subscriber shall be those available using the white label administration application on XxxxXxxx.xxx.
5.2. In creating the Customised Site, the Subscriber shall not include any, or links to any, material on the Customised Site that:
(a) promotes, supports or refers any End Users to a direct competitor of Galileo except with the prior agreement of Galileo in writing;
(b) discriminates or advocates or endorses discrimination on the basis of race, ethnicity, gender, religion, sexual orientation, age or disability;
(c) is libellous, defamatory, obscene, pornographic, sexually explicit, abusive, offers or advocates use of illegal substances, advocates sedition or illegal activities or displays banners of or links to any other website that carries any such content;
(d) offers copyrighted items that are made available without the permission of the copyright owner or otherwise in violation of copyright law or provides indices of or links to such files or items;
(e) makes any representations or warranties on behalf of Galileo; or
(f) constitutes, involves or contributes to any violation or law or intellectual property or other rights of third parties.
5.3. The Subscriber shall be solely responsible for providing customer assistance services to End Users who use the Customised Site.
White Labelling. Vodia’s Products support white-labelling but Distributor or Customer where the Vodia brand appears as the manufacturer of the software.
White Labelling. The Services are provided white-labelled to External End Users. Customer is solely responsible for: (a) implementing and maintaining an adequate privacy policy to inform External End Users about Customer’s practices regarding Personal Information, including as a result of the Services; (b) ensuring that the Personal Information is collected lawfully, through an informed consent or otherwise as permitted by Applicable Laws; (c) responding to Individual Rights Requests from End Users and (d) ensuring that the Services are lawful based on Applicable Laws regarding Personal Information in the jurisdiction where Customer is located. Mako shall deploy adequate technical and organizational safeguards to assist Customer to comply with the foregoing, including, without limitation, by providing Customer with access to information as reasonably requested for this purpose.

Partnershall provide, in softcopy/electronic format as reasonably specified by InterPayments, the Partner-specific branding to be used to white-label the Services. InterPayments shall provide Partner with access to the white-labeled Services to review prior to making any production versions of the white-labeled Services commercially available for re-sale by Partner. Partner shall use commercially reasonable efforts to promptly review the white-labeled Services. The Partner-specific branding will be applied to the Services by InterPayments for the fees specified. InterPayments shall only use any Partner-specific branding materials provided to InterPayments for the purposes of re- branding the Services and for the operation of the white-labeled Services.
