Withholding of Completion Certificate. 14.4.1 If the Independent Engineer determines that the Mines and Equipment or any part thereof do not conform to the provisions of this Agreement, it shall forthwith make a report in this behalf and send copies thereof to the Authority and the Mine Operator. Upon receipt of such a report from the Independent Engineer and after conducting its own inspection, if the Authority is of the opinion that the Mines and Equipment are not fit and safe for commercial service, it shall, within 7 (seven) days of receiving the aforesaid report, notify the Mine Operator of the defects and deficiencies in the Mines and Equipment and direct the Independent Engineer to withhold issuance of the Completion Certificate, as the case may be. Upon receipt of such notice, the Mine Operator shall remedy and rectify such defects or deficiencies and thereupon Tests shall be undertaken in accordance with Article 14. Such procedure shall be repeated as necessary until the defects or deficiencies are rectified. 14.4.2 Notwithstanding anything to the contrary contained in Clause 14.4.1, the Authority may, at any time after receiving a report from the Independent Engineer under that Xxxxxx, direct the Independent Engineer to issue a Completion Certificate under Clause 14.3, and such direction shall be complied forthwith.

Upon receipt of such notice, the Mine Developer and Operator shall remedy and rectify such defects or deficiencies and thereupon Tests shall be undertaken at the cost and expense of Mine Developer and Operator. Such procedure shall be repeated as necessary until the defects or deficiencies are rectified.

Upon receipt of such notice, the Mine Developer and Operator shall remedy and rectify such defects or deficiencies and thereupon Tests shall be undertaken in accordance with Article-22. Such procedure shall be repeated as necessary until the defects or deficiencies are rectified.
Withholding of Completion Certificate. If HCL determines that the Mines, Concentrator Plant and equipment or any part thereof do not conform to the provisions of this Agreement, and HCL is of the opinion that the Mines, Concentrator Plant and equipment are not fit and safe for commercial service, it shall notify the MDO within 7 (seven) days, of the defects and deficiencies in the Mines and Equipment and withhold issuance of the Completion Certificate, as the case may be. Upon receipt of such notice, the MDO shall remedy and rectify such defects or deficiencies and thereupon Tests shall be undertaken in accordance with Article 14. Such procedures shall be repeated as necessary until the defects or deficiencies are rectified.

  • Completion Certificate (i) Upon completion of all Works forming part of the Project Highway, and the Authority’s Engineer determining the Tests to be successful and after the receipt of notarized true copies of the certificate(s) of insurance, copies of insurance policies and premium payment receipts in respect of the insurance defined in Article 20 and Schedule P of this Agreement, it shall, at the request of the Contractor forthwith issue to the Contractor and the Authority a certificate substantially in the form set forth in Schedule-L (the “Completion Certificate”). (ii) Upon receiving the Completion Certificate, the Contractor shall remove its equipment, materials, debris and temporary works from the Site within a period of 30 (thirty) days thereof, failing which the Authority may remove or cause to be removed, such equipment, materials, debris and temporary works and recover from the Contractor an amount equal to 120% (one hundred and twenty per cent) of the actual cost of removal incurred by the Authority. (iii) Without prejudice to the obligations of the Contractor specified in Articles 14 and 17, the property and ownership of all the completed Works forming part of the Project Highway shall vest in the Authority.
