Without limiting Clause A. 23, neither the Principal nor the Contractor will disclose information of the kind mentioned in section 275(1) of the PPSA, and the Contractor will not authorise, and will ensure that no other party authorises, the disclosure of such information. However, this does not prevent disclosure where required under section 275 of the PPSA because of the operation of section 275(7) of the PPSA.
Without limiting Clause A. 18.1, where the Principal becomes aware of any Defect during the carrying out of the Supply or during the Defects Liability Period (if applicable), it may direct the Contractor by Notice to, at its own cost and risk, rectify the Defect (by any one or more of repair, replacement or re-performance as determined by the Principal).
Without limiting Clause A. 21.1, where the Principal becomes aware of any Defect during the performance of the Works or during the Defects Liability Period, it may direct the Contractor by Notice to rectify the Defect.
Without limiting Clause A. 6.1, Crealis Labs’s network and Service(s) may only be used in accordance with this Agreement. The Customer shall comply at all times with all applicable laws and regulations, Crealis Labs’s operating procedures, and the Acceptable Use Policy. The Customer shall not use or permit the use of the Service(s), the Customer’s servers or Crealis Labs’s networks or servers in a fraudulent manner or in a manner that violates the Acceptable Use Policy or any applicable law or regulation, to communicate or publish Inappropriate Materials or in a manner which may expose Crealis Labs to legal liability.
A.6.3 The Customer shall fully indemnify, Crealis Labs against any and all claims, losses, damages, liabilities and expenses including, without limitation, reasonable legal fees, arising from or related to
(i) Service Misuse or a breach of any other provision of this Agreement; (ii) any claim of infringement of any Intellectual Property Rights or other proprietary interest based on the possession or use of any Service(s), software or equipment furnished to The Customer or The Customer’s end-user(s) and/or customer(s); (iii) any claim that any Material of The Customer, or the manner in which The Customer or The Customer’s customers and/or end users make use of the Services or any Material, constitutes an infringement of any Intellectual Property Rights of any third party; (iv) any acts, omissions or Defaults of The Customer, its employees, agents or representatives.
Without limiting Clause A. 16.1, the Principal may direct the Vendor by Notice to, at the Vendor’s cost and risk, rectify any Defect.

The Customer shall comply at all times with all applicable laws and regulations, Firstserv’s operating procedures, and the Acceptable Use Policy. The Customer shall not use or permit the use of the Service(s), the Customer’s servers or Firstserv’s networks or servers in a fraudulent manner or in a manner that violates the Acceptable Use Policy or any applicable law or regulation, to communicate or publish Inappropriate Materials or in a manner which may expose Firstserv to legal liability.
Without limiting Clause A. 6.1, Medhurst’s network and Services may only be used in accordance with the Agreement. The Customer shall, and shall procure Users shall, comply at all times with all Regulations, Medhurst’s operating procedures as notified to the Customer, and the Acceptable Use Policy. The Customer shall not use or permit the use of the Services, the Customer’s servers or Medhurst’s networks or servers in a fraudulent manner or in a manner that violates the Acceptable Use Policy or any Regulation, to communicate or publish Inappropriate Materials or in a manner which may expose Medhurst to legal liability.
