Work Warranty Period. Contractor shall remedy at its sole cost and expense any breach of the warranty set forth in Section 13.1 with respect to each SGF and the Work performed in connection therewith discovered within sixty (60) months after the Substantial Completion Date for such SGF (the "Work Warranty Period"), except to the extent Contractor performs warranty Work on such SGF after the Substantial Completion Date for such SGF, in which event the Work Warranty Period for each item of cure Work as is performed after such Substantial Completion Date shall be extended until the later of (i) the date that is six (6) months following the completion of such item of cure Work, and (ii) the expiration of original Work Warranty Period for such SGF. The foregoing shall not relieve Contractor of its obligation to correct defects and deficiencies (including breaches of the warranty set forth in Section 13.1) in such SGF that are discovered during the Work Warranty Period with respect thereto (or the extension thereof), even if such corrective action cannot be completed within said period. Following the expiration of the Work Warranty Period (and as to any cure Work, following the expiration of the extension of the Work Warranty Period) for a SGF, Owner expressly waives and releases Contractor from all claims, except those previously asserted, relating to defects or deficiencies in the Work with respect to such SGF, whether arising in contract, warranty, tort (including negligence), strict liability, equity or otherwise.

Work Warranty Period. The Work Warranty shall commence on the Substantial Completion Date and shall continue for a period of ten (10) years from the Final Completion Date (the “Work Warranty Period”); provided, however, that if any portion of the Work and/or any Materials is repaired or replaced pursuant to the Work Warranty, then the Work Warranty Period with respect to such Work shall continue until the later of (a) the expiration of the Work Warranty Period or (b) one (1) year from the date of completion of such repair or replacement. Work Warranty Period. The Work Warranty shall commence on the Substantial Completion Date and shall continue until and expire upon the second (2nd) anniversary of the Substantial Completion Date, or such longer period as required by applicable Law (such applicable period, the “Work Warranty Period”). Correction of Deficiencies. If any failure or breach of the Work Warranty occurs prior to the end of the Work Warranty Period, upon written notice from Company or Vendor otherwise becoming aware of such failure or breach, and upon written approval from Vendor within 10 Business Days that such claim is valid, so long as such notice or awareness occurs prior to the end of the Work Warranty Period, Vendor, at its sole cost and expense (including the cost of materials, transportation, labor and equipment), shall as soon as reasonably practicable repair or replace the Work and Materials, or take other appropriate corrective action to cause the Work and Materials to conform to the Work Warranty and remedy all other resultant damage to the Project in accordance with the requirements of this Agreement and in conformance and compliance with the Operations and Maintenance Manual.
Work Warranty Period. The Work Warranty shall commence on the date of interconnection and s hall continue until and e xpire upon the tenth (10th) anniversary of the date of interconnection (such applicable period, the “ Work Warranty Period”);; provided, however, that if Work is repaired or replaced pursuant to the Work Warranty, then the Work Warranty Period with respect to such component shall continue until the later of (i) the exp irat ion of the Work Warranty Period or (ii) one (1) year fro m the date of completion of such repair or replace ment.

  • Warranty Period Except as may be otherwise specified or agreed, Contractor shall repair all defects in materials, equipment, or workmanship appearing within one year from the date of Substantial Completion of the Work. If Substantial Completion occurs by phase, then the warranty period for that the Work performed for each phase begins on the date of Substantial Completion of that phase, or as otherwise stipulated on the Certificate of Substantial Completion for the particular phase.

  • Software Warranty We warrant that the Tyler Software will perform without Defects during the term of this Agreement. If the Tyler Software does not perform as warranted, we will use all reasonable efforts, consistent with industry standards, to cure the Defect in accordance with the maintenance and support process set forth in Section C(9), below, the SLA and our then current Support Call Process.

  • Warranty Work Failure by the Contractor to take corrective action within twenty four (24) hours after personal or telephonic notice by the County's OC Public Works on items affecting essential use of the facility, safety or the preservation of property, and within ten (10) calendar days following written notice on other deficiencies, will result in the County taking whatever corrective action it deems necessary. All costs resulting from such action by the County will be claimed against Contractor or, if necessary, the Contractor's Performance Bond.

  • Basic Equipment Warranty The Contractor warrants that all equipment rented or supplied under this Agreement shall be in good working order and shall conform to the needs specified by the Judicial Council. The Contractor shall immediately replace any inoperative equipment with operative equipment, or make all adjustments, repairs, and parts replacements required to maintain the equipment rented or supplied hereunder in working condition.
