Definition of terms. Capitalised terms shall be defined as follows, unless otherwise implied from the text of these PTC AP:
Definition of terms. 2.1 In addition to the general abbreviations introduced by these Terms and Conditions, the Operator explicitly modifies the following selected concepts of the life cycles of the functionalities of the PID Lítačka mobile application in its sub-provisions. The definitions of the terms already include the rights and obligations of the Clients in relation to the term and may be further supplemented or clarified within the other provisions of these Terms and Conditions. 2.2 User" is an umbrella term for clients who have downloaded the PID Lítačka mobile application to the Device; Users are further subdivided depending on the volume of use of the Services. Where these Terms refer to a User generally, the subject provision shall be deemed to apply to Registered and Non-Registered Users. 2.2.1 An "Non-Registered User" is identified by installing the PID Lítačka mobile application. Primarily this is a User who does not create an account. In the event that the User 2.2.2 A "Registered User", on the other hand, is a User who has proceeded to create an account. By creating a User Account, the Registered User receives additional benefits such as sending tax documents via e-mail, increased security of Tickets, transferring Tickets to other Devices (whether to another Registered User's Device or to another Device due to, for example, loss, theft or destruction of the Device), the possibility of using the PID Lítačka mobile application as an Identifier for Long-Term Fare, purchase of Long-Term Fare, management of Identifiers, etc.
Definition of terms. 1.1 „Price for Services" means the price for Services provided by the Landlord; their amount is stipulated in the Contract. 1.2 „Lease Term" means the period for which the Contract is concluded and which begins on the effective day of the Contract and ends at the end of a contractual period stipulated in the Contract.

In the event that the User does not create an account in the PID Lítačka mobile application at all, or does not log in to his/her account after registration when using the Services, his/her status as a Non-Registered User is assessed. 2.2.2 A "Registered User", on the other hand, is a User who has proceeded to create an account. By creating a User Account, the Registered User receives additional benefits such as sending tax documents via e-mail, increased security of Tickets, transferring Tickets to other Devices (whether to another Registered User's Device or to another Device due to, for example, loss, theft or destruction of the Device), the possibility of using the PID Lítačka mobile application as an Identifier for Long-Term Fare, purchase of Long-Term Fare, management of Identifiers, etc.
Definition of terms. 2.1. The terms used in this contract have the following meaning: Client: the Client is the contracting authority following the conclusion of the contract for the performance of a public project or contract. Contractor: the Contractor: is the supplier following the conclusion of the contract for the performance of a public project or contract. Subcontractor: the subcontractor is the subcontractor following the conclusion of the contract for the performance of a public project or contract.
Definition of terms. 2.1 The Sewerage Rules which are published, in their amended version, on the ▇▇▇.▇▇▇.▇▇ site determine the highest admissible rate of contamination of wastewater drained into the sewerage system, or the highest admissible volume of this water and other conditions for its release and operation of the sewerage system. In case of detection of the exceeding of the highest admissible rate of contamination determined by the Sewerage Rules the Supplier is authorised to take steps against the contamination originator in accordance with generally binding legal regulations and either to make an agreement with the originator on special sewage charges, covering increased costs of contamination removal or to file a motion for commencement of administrative proceedings with the originator exceeding the values determined by the Sewerage Rules. 2.2 The term “offtake termination” shall denote termination of the water supply to the Customer and/or termination of drainage of wastewater for the Customer. Further offtake (water supply and/or drainage of wastewater) without the written consent of the Supplier is a breach of the Contract. 2.3 Interruption of water supply and/or drainage of wastewater shall denote offtake termination and termination of drainage agreed upon for a definite time period. After the end of the term of the interruption the contractual relationship continues without any change. 2.4 The term “repair” shall denote removal of partial physical wear and tear or damage of the equipment for the purpose of its putting into the original or otherwise operable condition, which does not affect its functionality and properties. 2.5 The term “internal water main” shall denote the pipeline intended for water distribution on the plot of land or in the construction which follows up to the end of the water main connection line. The term “internal sewerage system” shall denote the pipeline intended for drainage of wastewater, or also rainwater from the construction, to its external face.

  • Místo a termín plnění 3.1 Místem plnění je sídlo Kupujícího, uvedené v záhlaví této Smlouvy, nedohodnou-li se Smluvní strany jinak. 3.2 Pro převzetí Předmětu plnění platí, že Kupující má právo odmítnout převzít Předmět plnění v případě, že podstatným způsobem neodpovídá této Smlouvě. Za podstatné se pro účely této Smlouvy považuje: a) Předmětem plnění je množství větší než objednané, v tomto případě má Kupující právo odmítnout množství, které přesahuje množství objednané, v případě, že toto šlo při předání jednoduchým způsobem bez použití dalšího zjistit, jinak má lhůtu 5 (pěti) pracovních dnů na odmítnutí tohoto plnění; pro splnění této lhůty postačí odmítnutí odeslat; b) Předmět plnění, který svou jakostí zcela zjevně neodpovídá Kupujícím objednanému Předmětu plnění; c) Nedodání kompletní dodávky, např. chybějící doklady k Předmětu plnění nebo chybějící výbava ve smyslu článku 1 odst. 1.2 této Smlouvy. 3.3 Lhůta dodání Předmětu plnění je 90 kalendářních dnů od účinnosti této Smlouvy. Konkrétní termín bude Prodávajícím dojednán alespoň 2 (dva) pracovní dny předem s Kontaktními osobami. Po nabytí účinnosti této Smlouvy se do lhůty dodání nezapočítávají kalendářní dny, po které Prodávající nebo výrobce Předmětu plnění přerušil z důvodu vyšší moci výrobu Předmětu plnění. O přerušení výroby Předmětu plnění z důvodu vyšší moci je Prodávající povinen informovat Kupujícího bez zbytečného odkladu.

  • Final provisions 5.1. Term and termination of the Agreement: This Agreement is concluded for a definite period of time until 31 December 2025. This Agreement comes into force on the day of its signing by the representatives of both Contracting Parties and becomes effective on the day of its publication in the Register of Contracts under Act No. 340/2015 Coll., on the Register of Contracts, as amended. The Contracting Parties may withdraw from the Agreement without undue delay for the reason of material breach hereof, for which breach of rights and duties arising from point 3.1. or 3.2. hereof shall be considered among others. The Contracting Parties may terminate this Agreement by a notice without giving reasons with a 2-month notice period, which shall commence on the first day of the month following delivery of the written notice to the other Contracting Party. 5.2. Penalties: In case of a breach of obligations stipulated in point 3.1. hereof, the Agent shall lose the right to payment of the commission not yet paid. If such breach concerns a particular Interested Person or a particular number of Interested Persons, the Agent loses the right to payment of such part of the commission which corresponds to mediation of the contract with such Interested Person/Interested Persons. Applying of penalty under letter a) shall not affect the right to compensation for damage. 5.3. Confidentiality The Contracting Parties undertake that in case of termination of contractual relations for any reasons they shall be obliged to maintain necessary confidentiality for the period of at least two years from termination thereof concerning information and data which they obtained from mutual cooperation and they undertake not to use such information, data and knowledge in the same area of business for such period. 5.4. Governing law Legal relations between the Contracting Parties including possible disputes arising herefrom shall be governed solely by applicable provisions of Act No. 89/2012, Civil Code, as amended, and other generally binding legal regulations of the Czech Republic. 5.5. Changes of the Agreement Any and all changes hereof may be made only by written amendments numbered in ascending order and approved and signed by both Contracting Parties. 5.6. Language versions The Agreement is drawn up in two language versions and both of them have the same content. In the case of any contradiction between the versions or dispute on interpretation of the Agreement or individual provisions, the Czech language version shall prevail. 5.7. GDPR When processing personal data of Interested Persons and Students, the Agent is obliged to comply with Act No. 101/2000 Coll. on the protection of personal data, as amended, as well as Directive 2016/679 of the European Parliament and of the Council (EU) of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data. 5.8. Force Majeure If the provision of services under the agreed conditions becomes impossible or so difficult as a result of force majeure that they cannot be fairly demanded, the party wishing to invoke force majeure shall request the other party to modify the Agreement in relation to subject matter, price and time of performance. If no agreement is reached, the Party who has reasonably invoked force majeure has the right to withdraw from this Agreement by a unilateral statement sent by registered letter to the other Party. In this case, the withdrawal shall take effect on the date of delivery of the notification to the other Contracting Party. 5.9. Final provisions This Agreement is drawn up in two (2) counterparts, each of which has the validity of the original, and each Contracting Party shall receive one (1) of them. Or it may be concluded electronically in which case both of the Contracting Parties share the original electronic document with the electronic signatures attached. The Contracting Parties declare that they have read this Agreement, they agree with its content and they confirm that it has been drawn up on the basis of true data, their true and free will and has not been agreed in distress or under other unilaterally disadvantageous conditions.
