V případě, že Xxxxx nepředloží kandidáta uvedeného v předchozím odstavci, Antal neobdrží nebo vrátí Klientovi přijatý poplatek za službu záruka. Klient uděluje společnosti Xxxxx nevýhradní, časově a územně neomezenou licenci k užívání verbálních, grafických a slovně- grafických znaků identifikujících klienta v nezbytném rozsahu a přispívá k plnění smlouvy. Xxxxx získává zejména právo: umístit označení do obchodní dokumentace související s plněním smlouvy; používat označení v obchodních, marketingových, reklamních a propagačních činnostech prováděných Antalem; v oblasti záznamu a reprodukce označení - výroba a reprodukce označení pomocí specifické techniky, včetně tisku, reprografie, magnetického záznamu a digitální technologie, v oblasti šíření označení - zobrazování, reprodukce a vysílání, jakož i veřejné zpřístupňování označení takovým způsobem, aby k nim mohl mít každý přístup na místě a v čase, který si zvolí. Spolu s první objednávkou poskytne klient Antalu elektronicky soubory obsahující aktuální grafické a slovně grafické označení identifikující klienta. Půjčitel je povinen zajistit vypůjčiteli servis a pravidelné kontroly event. validace předmětu výpůjčky v souladu se zákonem č. 268/2014 Sb., v platném znění, na vlastní náklady po dobu výpůjčky a to od doby uvedení do provozu s tím, že opravy předmětu výpůjčky budou prováděny dle možností půjčitele v co nejkratší době. Náklady spojené s výměnou předmětu výpůjčky z běžných důvodů opotřebení bude provádět na své náklady půjčitel.
