ADDITIONAL PROVISIONS. 9.1. Upon change of the data used as a basis for the opening of the Savedo Account or concluding the Contract, the Client shall be obliged to immediately notify Savedo and CKV to that effect in writing and to provide them with current/valid documentation. Changes will have effect in relation to CKV only from the moment in which it was notified in writing of their occurrence. These changes will include but are not limited to: 9.1.1. for individuals: about change of the name, surname, address, telephone number or other contact information, initiation and course of insolvency proceedings; 9.1.2. about loss or theft of identity documents of the Client: natural person or other cases when identity documents get into the possession of third parties against the Client's will; 9.1.3. about loss or theft of the authentication information or other cases when such information gets into the possession of third parties against the Client's will. 9.2. CKV shall not be responsible for damages or lost profits due to inaccuracies, errors or delays in the transfer of information and/or documents due to force majeure, technical, communication or other causes beyond the control of CKV, as well as in cases where CKV has acted to fulfill a legal obligation under the existing Belgian law or European Union law. Bankgeheimnis – Fakten und Umstände, die bei der Ausführung der in diesen AGB bestimmten Dienstleistungen bekannt wurden, unterliegen dem Bankgeheimnis. Information hierüber darf nur dem Kunden bzw. anderen Personen nur mit Einwilligung des Kunden oder aufgrund gesetzlicher Umstände und Verfahren gewährt werden. 9.5. Durch Übermittlung des Antrags auf eine Festgeldeinlage erteilt der Kunde der CKV ausdrücklich sein schriftliches Einverständnis, der flatexDegiro Bank und Savedo Zugang zu Informationen zu gewähren, die dem Bankgeheimnis unterliegen können oder personenbezogene Daten sind, zum Zweck der Darstellung der Statusanzeige seiner Festgeldeinlage bei der CKV oder zum Zweck der Kommunikation zwischen der CKV und dem Kunden in seiner Eigenschaft als Kunde. 9.6. Maßnahmen gegen Geldwäsche – Der Kunde wurde informiert, dass gemäß der aktuellen Gesetzeslage Banken Maßnahmen ergreifen, um die Nutzung des Finanzsystems zum Zweck der Geldwäsche zu verhindern, und erklärt sich damit einverstanden, sich im Einklang mit den Verfahrensanforderungen der CKV zu verhalten, Daten zur Verfügung zu stellen und die CKV bei der Umsetzung der Maßnahmen gegen Geldwäsche zu unterstützen. 9.7. Der Kunde wird dazu verpflichtet, die nötige Sorgfalt walten zu lassen und das Savedo-Konto und die Festgeldeinlage im Einklang mit gültigen Gesetzen, Bankvorschriften, diesen AGB und dem abgeschlossenen Vertrag zu nutzen. Er soll nicht, durch sich selbst oder Dritte, die Festgeldeinlage zu Betrugszwecken oder sonstigen gesetzeswidrigen Aktivitäten nutzen, die Sicherheit (auch der Konten anderer Kunden) durch unbefugten Zugang gefährden oder Handlungen unternehmen, welche die Reputation und die Glaubwürdigkeit der CKV schädigen können. 9.7.1. Die Bank ist dazu berechtigt, Kopien der Dokumente anzufertigen, die vom Kunden eingereicht / vorgelegt werden (einschließlich Dokumenten, die für die Identifizierung oder Erkennung des Kunden eingereicht wurden). 9.7.2. Die CKV ist grundsätzlich dazu berechtigt, jeden Antrag auf einen Festgeldvertrag ohne Angabe von Gründen abzulehnen. 9.3. Personal data - CKV shall store and process the personal data of the Client with due care and in compliance with the current legislation on personal data protection. The Client may at any time request to receive free of charge information on the personal data that has been collected on him, or request that such data is corrected, blocked or deleted if storing it is no longer necessary under the current legislation. 9.4. Bank secrecy - Bank secrecy represent all information, facts and circumstances of which CKV came aware in the course of providing services under these GTC. Information representing bank secrecy shall only be disclosed to the Client or to other persons subject to consent by the Client, or under the conditions and procedures established by law. 9.5. By submitting the Application for opening a Term Deposit, the Client gives CKV his explicit written consent to provide flatexDegiro Bank and Savedo with data and information constituting bank secrecy or personal data for the purposes of providing the Client with information on the status of his Term Deposit with CKV, or for the purposes of communication between CKV and the Client in his capacity as Client. 9.6. Measures against Money Laundering - The Client has been informed that under the current legislation banks implement measures to prevent the use of the financial system for the purposes of money laundering and agrees to comply with the procedures required by CKV, to provide data and to assist in the implementation of provisions for enforcement of measures against money laundering. 9.7. The Client shall be obliged to exercise due care and use the Savedo account and the Term Deposit in accordance with current legislation, banking requirements, these GTC and the specific Contract concluded with them. The Client should not allow, personally or through third parties, the use of the accounts for fraudulent or illegal operations, jeopardize their security (or that of other Clients’ accounts) by attempts for unauthorized access, or perform any actions that could damage the reputation or credibility of CKV. 9.7.1. CKV has the right to make copies of documents submitted/presented by the Client to CKV (including documents submitted for identification or recognition of the Client). 9.7.2. CKV has the right to decline applications without giving any reason(s).
