401(k) Plans definition
401(k) Plans has the meaning set forth in Section 6.5.
401(k) Plans shall have the meaning set forth in Section 6.16. Other terms used herein are defined in the preamble and elsewhere in this Agreement.

Examples of 401(k) Plans in a sentence
If Parent provides an Election Notice to the Company, the Company shall deliver to Parent, prior to the Closing Date, evidence that the Company Board has validly adopted resolutions to terminate the 401(k) Plans (the form and substance of which resolutions shall be subject to review and approval of Parent), effective no later than the date immediately preceding the Closing Date and contingent on the Closing.
