Additional Second Lien Documents definition

Additional Second Lien Documents means the Additional Second Lien Debt Facility and the Additional Second Lien Security Documents.

Additional Second Lien Documents means, with respect to any Series of Additional Second Lien Debt, the loan agreements, promissory notes, indentures and other operative agreements evidencing or governing such Indebtedness, any document governing reimbursement obligations in respect of letters of credit issued pursuant to any Additional Second Lien Documents and the Second Lien Collateral Documents securing such Series of Additional Second Lien Debt.

Additional Second Lien Documents means (a) each Additional Second Lien Agreement and each of the other agreements, documents or instruments evidencing, governing or securing any Additional Second Lien Obligations and (b) any other related documents or instruments executed and delivered pursuant to any Second Lien Document described in clause (a) above; provided, however, for the avoidance of doubt, none of the Indenture Documents shall constitute Additional Second Lien Documents.

• To the extent, but only to the extent, permitted by the provisions of the Credit Agreement and the Additional Second Lien Documents, the Borrower may incur additional indebtedness after the date hereof that is permitted by the Credit Agreement and the Additional Second Lien Documents to be incurred and secured on an equal and ratable basis by the Liens securing the Second Lien Obligations (such indebtedness referred to as “Additional Senior Class Debt”).

• The Contractor shall retain all records relating to this contract for a period of at least three (3) years after final payment is made.

• To the extent, but only to the extent permitted by the provisions of the Credit Agreement and the Additional Second Lien Documents, Holdings, the Borrower and the other Grantors may incur Additional Second Lien Obligations.

More Definitions of Additional Second Lien Documents

Additional Second Lien Documents means, with respect to any Series of Additional Second Lien Debt that is designated as Additional Second Lien Obligations pursuant to Section 8.7, (i) the loan agreements, promissory notes, indentures, guarantees and other operative agreements evidencing or governing such Indebtedness, any document governing reimbursement obligations in respect of letters of credit issued pursuant to any Additional Second Lien Documents and (ii) the Second Lien Collateral Documents securing such Series of Additional Second Lien Debt, in each case, without regard to any provision thereof that contravenes Section 5.3 of this Agreement.

Additional Second Lien Documents means, with respect to the Initial Additional Second-Lien Obligations or any other Additional Second-Lien Obligations, the credit agreements, notes, indentures, security documents and other operative agreements evidencing or governing such Indebtedness and the Liens securing such Indebtedness, including the Initial Additional Second-Lien Documents and the Additional Second-Lien Security Documents and each other agreement entered into for the purpose of securing the Initial Additional Second-Lien Obligations or any other Additional Second-Lien Obligations.

Additional Second Lien Documents means, with respect to any Series of Additional Second Lien Obligations, the notes, indentures, security documents and other operative agreements evidencing or governing such Additional Second Lien Obligations, including each agreement entered into for the purpose of securing such Additional Second Lien Obligations; provided that, in each case, such Additional Second Lien Obligations have been designated as Additional Second Lien Obligations pursuant to and in accordance with Section 8.10(b).

Additional Second Lien Documents means, with respect to the Initial Additional Second Lien Obligations or any Series of Additional Senior Class Debt, the notes, indentures, credit agreements, security documents and other operative agreements evidencing or governing such indebtedness and liens securing such indebtedness, including the Initial Additional Second Lien Documents and the Additional Second Lien Security Documents and each other agreement entered into for the purpose of securing the Initial Additional Second Lien Obligations or any Series of Additional Senior Class Debt; provided that, in each case, the Indebtedness thereunder (other than the Initial Additional Second Lien Obligations) has been designated as Additional Senior Class Debt pursuant to Section 5.12 hereto.

Additional Second Lien Documents means the indentures or other agreements under which Additional Second Lien Obligations of any Class are issued or incurred and all other notes, instruments, agreements and other documents evidencing or governing Additional Second Lien Obligations of such Class or providing any guarantee, Lien or other right in respect thereof.

Additional Second Lien Documents has the meaning assigned to such term in Section 2.08(b).
