Air Transportation Business definition

Air Transportation Business means the carriage by aircraft of persons or property as a common carrier for compensation or hire, or carriage of cargo or mail by aircraft, in air commerce, as defined in 49 U.S.C. § 40102, as amended.

Air Transportation Business means that business operated by AIRLINE at the Airport for the commercial transportation by air of persons, property, mail, parcels and/or cargo.

Air Transportation Business means the carriage by aircraft of persons, cargo or property as a common airline for compensation or hire, or the carriage of mail, by aircraft, in commerce as defined in the Federal Aviation Act of 1958, as amended.

• Authority hereby agrees to lease to Airline and Airline hereby agrees to lease from Authority in support of Airline’s Air Transportation Business, certain real property as set forth in this Article 4 (collectively, the “Airline Premises”).

• The Airline will bear, at its own expense, all costs of operating its Air Transportation Business including all applicable sales, use, intangible, special assessments, and real estate taxes of any kind, including ad valorem and non-ad valorem, which are assessed against the Airline’s use and occupancy of its Airline Premises, and any improvements thereto or leasehold estate created herein, or assessed on any payments made by the Airline hereunder, whether levied against the Airline or the Authority.

• The Airline will obtain and maintain throughout the Term, all permits, licenses, or other authorizations required by Applicable Laws in connection with the operation of its Air Transportation Business on its Airline Premises or at the Airport.

• Nothing in this Article 5 shall be construed as authorizing AIRLINE to conduct any business separate and apart from the conduct of its Air Transportation Business.

• Except with the prior written approval of the Authority, the Airline is prohibited from conducting any business on the Airport separate and apart from the conduct of its Air Transportation Business.

• The rights granted to the Airline under this Agreement shall be strictly construed, and may be exercised by the Airline only to the extent such rights are necessary or incidental to the conduct by the Airline of its Air Transportation Business.

• During the Term, Affiliated Airline shall, at its own expense, provide, pay for, and maintain with companies reasonably satisfactory to the Authority the types of insurance under the terms and conditions set forth in the Space Rental Agreement as if such terms and conditions were set forth herein and applicable to Affiliated Airline and its Air Transportation Business at the Airport hereunder.

• The training of personnel in the employ of or to be employed by AIRLINE and the testing of aircraft and other equipment being utilized at the Airport in the operation of AIRLINE's Air Transportation Business; provided, however, said training and testing shall be incidental to the use of the Airport in the operation by AIRLINE of its Air Transportation Business and shall not unreasonably hamper or interfere with the use of the Airport and its facilities by others entitled to the use of same.

• Affiliated Airline (or Airline on behalf of Affiliated Airline) shall provide the Authority, on the Effective Date, with a direct pay irrevocable letter of credit or other similar security acceptable to the Authority (“Payment Security”) under the terms and conditions of the Space Rental Agreement as if such terms and conditions were set forth herein and applicable to Affiliated Airline and its Air Transportation Business at the Airport hereunder.

More Definitions of Air Transportation Business

Air Transportation Business means the business of a Scheduled Air Carrier for the commercial transportation by air Air Transportation Company shall mean (i) a Scheduled Air Carrier or (ii) a company engaged in non-scheduled common carriage by air of persons, property, and/or mail. Aircraft Parking Positions shall mean those portions of the Ramp Area at each of the Airports that are used for the parking of aircraft and support vehicles and the loading and unloading of passengers and cargo.
