Approved Subdivision definition

Approved Subdivision means a residential subdivision located in Texas in which Borrower is actively engaged in the construction of single-family residences and which is otherwise acceptable to Lender in all respects, as determined by Lender in its sole discretion.

Approved Subdivision means a Subdivision that has been approved as provided in SECTION 4.2.

Approved Subdivision means any Subdivision (and each of the Lots and Units contained therein) approved by Lender as of the Closing Date, and such other Subdivisions which may be approved by Lender from time to time after the Closing Date pursuant to Article 4.

Notwithstanding the foregoing, before any Advance is made with respect to a Lot or Home in Xxxxxxxxx, Shoenberg Farms, Montecito at Ridgegate, or Waterside Park, Lender shall have received and approved a Phase I Environmental analysis for the relevant subdivision. In addition, before any Advance is made with respect to a Lot or Home in Montecito at Ridgegate, a subordination agreement reasonably acceptable, in form and substance, to Lender and Title Company shall have been executed by the seller of the Lots in Montecito at Ridgegate to fully subordinate such seller’s lien on such Lots, which subordination agreement shall be recorded in the real estate records of Xxxxxxx County, Colorado.

Approved Subdivision set forth in Section 1.9 of the Loan Agreement is hereby amended to include the subdivision known as in County, Colorado.
