Each Attachment, Fee Schedule, Exhibit or other documents referenced herein and/or attached to this Agreement are incorporated herein as if the same was set out in full in the text of this Agreement.
The Initial Annual Collocation on Service Pole Attachment Fee Payment shall be pro-rated for the months remaining in the calendar year after the permit issuance date.
The annual collocation on Service Pole attachment fee payment for the first year at any Location (“Initial Annual Collocation on Service Pole Attachment Fee Payment”) begins accruing when the permit is issued and is due 30 days after Licensee obtains a Permit to install or collocate a Network Node at the Location.
Licensee, however, shall be responsible for all Make-Ready Work and other charges associated with the Overlashing but shall not be required to pay a separate Annual Attachment Fee for such Overlashed Attachment.
The Attachment Fee referenced in this subsection 14.1 shall be determined in the same manner as such fee would have been determined if the attachment had been authorized by GTE.
Licensee also shall pay GTE an Attachment Fee for each unauthorized Attachment accruing from the date the unauthorized Attachment was first placed on the GTE pole.
A Nonfunctional Attachment that Licensee has failed to remove as required in this paragraph shall constitute an unauthorized Attachment and is subject to the Unauthorized Attachment Fee specified in Appendix A.
The Attachment Fee may be increased by GTE from time to time as permitted by law upon sixty (60) days written notice to Licensee.
There will be no Attachment Fee or License Fee due to Licensor for a Public Highway Access Grant.
Absent such authorization, an Overlash constitutes an unauthorized Attachment and is subject to the Unauthorized Attachment Fee specified in Appendix A.
