Building Business Hours: 7:00 a.m. to 6:00 p.m. on Business Days.
Apart from "Normal Building Business Hours", the Tenant shall have access to the Premises twenty-four (24) hours a day each and every day of the year throughout the Term, except for unforeseen Building emergencies.
Without the consent of Landlord, Tenant’s use of electrical service shall not exceed, either in voltage, rated capacity, use beyond Building Business Hours or overall load, that which Landlord reasonably deems to be standard for the Building.
Landlord agrees to furnish cleaning and janitorial service after Building Business Hours on generally recognized business days (but exclusive in any event of Saturdays, Sundays and national and local legal holidays).
Tenant shall reimburse Landlord at the then rate being charged by Landlord in the Building for HVAC service provided outside of Building Business Hours (which shall not be less than $40 per hour per floor).
Upon Tenant’s giving reasonable advance notice in making any request for air circulation outside of Building Business Hours, Landlord shall provide the same.
Subject to the Rules and Regulations, Landlord shall furnish or arrange for the applicable utility provider to furnish to the Premises, (a) water for lavatory and drinking purposes, (b) electricity, (c) during Building Business Hours (except on Holidays) ventilation as provided by the Base Building Systems, and (d) elevator service, which shall mean service either by nonattended automatic elevators or elevators with attendants, or both, at the option of Landlord.
If Tenant desires HVAC at a time other than normal Building Business Hours as defined in Section 1.1: (i) Tenant shall give Landlord such prior notice as Landlord shall from time to time establish as appropriate of Tenant’s desired use; (ii) Landlord shall supply such after-hours HVAC to Tenant at such hourly costs to Tenant as Landlord shall from time to time establish; and (iii) Tenant shall pay such cost within ten (10) days after billing.
If Tenant requires heating, ventilating, or air conditioning ("HVAC")at times other than Building Premises Hours, the cost to Tenant shall be $60 per hour which cost is subject to increase based on increases in Landlord's costs (direct and indirect); provided, however, in no event shall Tenant be charged more than $250.00 per calendar day for HVAC at times other than Building Business Hours.
Notwithstanding the foregoing, as an energy conservation measure, Landlord will not run heating and air conditioning equipment serving the Premises on Saturdays unless requested by Tenant (provided that Tenant shall not be charged for such Saturday service unless it is outside of Building Business Hours).
