Certification for Payment definition

Certification for Payment means the certificate to be provided by the Developer, or his designee, to substantiate the Actual Cost of one or more Authorized Improvements.
Certification for Payment means a certification for payment substantially in the forms of Exhibit D attached to the Financing Agreement executed by Forestar (USA) Real Estate Group, Inc. and submitted to the City and approved by the City Representative, specifying the amount of work performed and the Actual Costs thereof, and requesting payment for such Actual Costs from money on deposit in accounts of the Project Fund as further described in the Financing Agreement and Section 6.5 herein.
Certification for Payment means a certificate executed by an engineer, construction manager or other person or entity acceptable to the City, as evidenced by the signature of a City Representative, specifying the amount of work performed and the cost thereof, presented to the Trustee to request funding for Costs from money on deposit in the Project Fund. Each Certification for Payment shall be substantially in the form attached hereto as Exhibit A.

  • Furthermore, notwithstanding anything contained herein to the contrary, in the event a subcontractor supplying labor or materials for an Improvement Area #1 Improvement claims that the subcontractor has not been paid for such labor or materials and has filed a mechanics lien, the City Construction Representative shall not be obligated to authorize payment of a Certification for Payment until such claim is resolved.

  • The City Construction Representative shall forward the executed Certification for Payment to the Finance Director who shall then have up to ten (10) calendar days to forward the same to the Trustee for payment.

Certification for Payment means a certificate, substantially in the form of Exhibit B hereto or otherwise agreed to by the Developer and the City, specifying the amount of work performed and the amount charged for that work, including materials and labor costs, provided each month to the City by the Developer and approved by the City Engineering Consultant and the Inspector, to request payment from the Construction Fund for Authorized Improvement Costs.
