COD Conditions definition

COD Conditions has the meaning given in clause 8.1 (“COD Conditions”).
COD Conditions means all of the requirements that must be satisfied by Seller as a prerequisite to achieving Commercial Operation. The COD Conditions are set forth in Section 4.5.
COD Conditions means all of the following: The Facility has been constructed in conformity with Section 3.2.

  • A COD Notice shall include all necessary supporting documentation of the satisfaction or occurrence of all COD Conditions.

  • Seller may notify Company of completion of one or more COD Conditions on an individual and incremental basis prior to COD, provided, however, that Company shall in all cases have up to 10 Business Days to review and object to each such notice.

  • Company shall have 10 Business Days to review a COD Notice and raise any Commercially Reasonable objection to Seller’s satisfaction of any of the COD Conditions, provided, however, that Seller’s COD Notice shall be deemed accepted by Company if Company fails to object within such time period.

  • The Parties shall cooperate to facilitate Seller’s testing of the Facility necessary to satisfy the COD Conditions.

  • The COD Conditions are for the benefit of the Commonwealth and may only be waived by the Commonwealth in writing.

  • Company shall have thirty (30) Business Days to review a COD Notice and raise any objection to Seller’s satisfaction of any of the COD Conditions, provided, however, that Seller’s COD Notice shall be deemed accepted by Company as of the date of delivery if Company fails to object within such time period.

  • The Parties shall cooperate to facilitate Seller’s testing of the Facility necessary to timely satisfy the COD Conditions.

  • If: Project Operator has notified the Commonwealth under paragraph (a); or the COD Conditions have not been satisfied on or before the COD Sunset Date, then the Commonwealth may at its discretion give Project Operator a notice requiring Project Operator to submit a cure plan which demonstrates that Project Operator is reasonably likely to achieve the COD Conditions (“Draft COD Cure Plan”).

Related to COD Conditions

  • Interior means the spaces, parts, components or elements of an individual dwelling unit.

  • Repair means to restore to proper operating condition a tank, pipe, spill prevention equipment, overfill prevention equipment, corrosion protection equipment, release detection equipment or other UST system component that has caused a release of product from the UST system or has failed to function properly.

  • Systems and Equipment means any plant (including any central plant), machinery, transformers, duct work, cable, wires, and other equipment, facilities, and systems designed to supply heat, ventilation, air conditioning and humidity or any other services or utilities, or comprising or serving as any component or portion of the electrical, gas, steam, plumbing, sprinkler, communications, alarm, lab, security, or fire/life safety systems or equipment, or any other mechanical, electrical, electronic, computer or other systems or equipment which serve the Building and/or any other building in the Project in whole or in part.

  • Pests means Birds, Vermin and Insects.

  • Property, Plant and Equipment means any item of real property, or any interest therein, buildings, improvements and machinery.

  • Military equipment means weapons, arms, military supplies, and equipment that readily may be used for military purposes, including, but not limited to, radar systems or military-grade transport vehicles; or supplies or services sold or provided directly or indirectly to any force actively participating in armed conflict in Sudan.

  • Plumbing means plumbing as defined in Section 1(1) of the Act.

  • Common Areas and Facilities means collectively the Development Common Areas and Facilities and the Residential Common Areas and Facilities and all those parts and such of the facilities of the Development designated as common areas and facilities in any Sub-Deed;

  • Emergency Repairs means repairs to a utility facility located in or adjacent to a primary city street that must be performed immediately when the necessity arises to safeguard life or property or maintain continued operation of the facility.

  • Specialty Alterations means Alterations consisting of kitchens, executive bathrooms, raised computer floors, computer installations, vaults, libraries, internal staircases, dumbwaiters, pneumatic tubes, vertical and horizontal transportation systems, and other Alterations of a similar character.

  • Appliances means and include electrical, mechanical and electronic appliances such as refrigerator, television, DVD player, videocassette recorder/player, washing machine, microwave oven, music system, personal computer, laptops and air-conditioner contained or fixed in the Insured’s home for domestic use.

  • Machinery and equipment shall have the meaning specified in Section 1.1(c).

  • Additional Equipment means equipment that is not factory fitted in the Vehicle, including but not limited to navigation equipment (GPS), baby seat, bicycle rack etcetera;

  • Common Areas is defined as all areas and facilities outside the Premises and within the exterior boundary line of the Project and interior utility raceways and installations within the Unit that are provided and designated by the Lessor from time to time for the general non-exclusive use of Lessor, Lessee and other tenants of the Project and their respective employees, suppliers, shippers, customers, contractors and invitees, including parking areas, loading and unloading areas, trash areas, roadways, walkways, driveways and landscaped areas.

  • Leasehold Improvements means all buildings, structures, improvements and fixtures located on any Leased Real Property which are owned by any Group Company, regardless of whether title to such buildings, structures, improvements or fixtures are subject to reversion to the landlord or other third party upon the expiration or termination of the Lease for such Leased Real Property.

  • Serviceable when used to describe an Engine or Part, means in an airworthy condition within the limits defined in the applicable Engine manuals, specification and/or publications by the type certificate holder.

  • Plumbing system means water supply distribution and disposal piping on the premises, including appliances and equipment attached thereto, between their connection points to a public or private system.

  • Optional equipment means all the features not included in the standard equipment which are fitted to a vehicle under the responsibility of the manufacturer, and that can be ordered by the customer.
