Comparable Customer definition

Comparable Customer shall have the meaning set forth in Section 4.4 to this Agreement.
Comparable Customer means either (a) a wholesaler that purchases KCD-Branded Products from Seller for resale to end-user consumers in the Territory, or (b) Seller’s licensee that Seller has licensed to arrange for the manufacture of KCD-Branded Products and their resale to end-user consumers in the Territory.
Comparable Customer means any DoubleClick Web site publisher customer that enters into an agreement with DoubleClick after the date this Agreement is fully executed, pursuant to which such DoubleClick Web site publisher customer receives overall pricing for services (calculated as the effective pricing for all services provided by DoubleClick to such customer after taking into account such customer's actual account experience) that is more favorable than the overall pricing for services received by Compaq under this agreement; provided that such DoubleClick Web site publisher customer shall only be deemed a "Comparable Customer" if comparable to Compaq in terms of the Banner size and bandwidth required for the Banners delivered or to be delivered.

  • In the event CP enters into an e-mail services agreement ("Comparable Agreement") with any Comparable Customer which charges prices to the Comparable Customer that are lower than the corresponding prices set forth in Exhibit B, CP shall also reduce the prices of its E-Mail Hosting Services to NSI.

Comparable Customer means a non-airline customer that is based in the United States or Canada; provided, that in the event Orbitz is Using the ITA Technology for an Orbitz Site that is based in another geographic region, then such Orbitz Site shall be entitled to the benefits of this Section 9 with respect to terms offered by ITA to a customer in such geographic region. For example, if Orbitz operated an Orbitz Site in the Asian market, and ITA provided the ITA Technology to another non-airline customer in the Asian market, then such Orbitz Site (but no other Orbitz Sites) will be entitled to receive pricing and terms at least as favorable as those provided by ITA to such other Asian market customer. In determining whether the terms charged to a third party are “more favorable,” ITA will take into account the number of transactions for which a customer is using the ITA Technology, the duration of the license, the amount of integration work required, the minimum fees payable, the expected volume of transactions, and whether or not there is a per-transaction component to the pricing.
