Compensable Curtailment definition

Compensable Curtailment means Net Output that is curtailed during the Term other than as a result of Non-Compensable Curtailment, including curtailment due to or arising out of any scheduling, bidding or other market activities by PacifiCorp (acting in its merchant function capacity).
Compensable Curtailment means Net Output that is curtailed for economic reasons by PacifiCorp (acting in its merchant function capacity) or that PacifiCorp otherwise refuses to take for economic reasons during the Term and that is not Non-Compensable Curtailment.
Compensable Curtailment means a curtailment of generation or delivery of Renewable Energy following COD arising out of the following (and only the following):

Examples of Compensable Curtailment in a sentence

  • Seller must promptly provide PacifiCorp with access to such information and data as PacifiCorp may reasonably request to confirm to its reasonable satisfaction the amount of any Non-Compensable Curtailment Energy or Compensable Curtailment Energy.

  • PacifiCorp shall pay Seller for Compensable Curtailment Energy as set forth in Section 5.1.3.

  • The price provided for Test Energy in Section 5.1.1, the Contract Price provided for in Section 5.1.2, and the Compensable Curtailment Price provided for in Section 5.1.3 include the consideration to be paid by PacifiCorp to Seller for all Net Output, Green Tags, Capacity Rights and Test Energy, respectively, and Seller shall not be entitled to any compensation over and above the Contract Price or the Test Energy price, as the case may be, for the Green Tags and Capacity Rights associated therewith.

  • If, during the period beginning on the later of (i) the Commercial Operation Date or (ii) the Scheduled Commercial Operation Date and thereafter during the Term, Net Output is curtailed by PacifiCorp and such curtailment is not included as a Non-Compensable Curtailment (“Compensable Curtailment Energy”), then PacifiCorp shall pay to Seller the Compensable Curtailment Price for the Compensable Curtailment Energy, as determined below.

  • Any disputes between the Parties with respect to the amount or calculation of Compensable Curtailment Energy or Non-Compensable Curtailment Energy will be resolved in accordance with Section 24.


More Definitions of Compensable Curtailment

Compensable Curtailment shall have the meaning set forth in (a)
Compensable Curtailment and “Compensable Curtailment Energy” shall have the meanings set forth in Section 8.3(B).
Compensable Curtailment means any curtailment of (i) PV Delivered Energy, (ii) PV System Energy or (iii) XXXX Metered Output that results in curtailment of PV System Energy due to (a) Buyer’s failure to schedule PV System Energy available for scheduling hereunder, except during any Curtailment Period and unless excused by Seller’s failure to perform or Seller’s Default, (b) the manner in which Buyer or the Scheduling Coordinator causes the Delivered Energy, XXXX Metered Output or PV System Energy to be (or not to be) bid, offered or Scheduled into CAISO, including as a result of Buyer or the Scheduling Coordinator Scheduling XXXX Metered Output in a manner that gives rise to a curtailment of PV System Energy or PV Delivered Energy, or (c) a request by Buyer to curtail PV Delivered Energy for any economic, preferential or discretionary reasons, which in any of the foregoing cases (a) – (c) shall be paid by Buyer at the applicable Contract Price.
Compensable Curtailment shall have the meaning set forth in Section 7.2(C). “Compensable Curtailment Energy” shall have the meaning set forth in Section 7.2(B)2. “Confidential Information” shall have the meaning set forth in Section 19.18(A).

Compensable Curtailment means a curtailment of generation or delivery of Renewable Energy following COD arising out of the following (and only the following): a curtailment of the Facility by Company under Section 8.3(A) ; disconnection of the Facility from the Transmission Authority’s System pursuant to the Interconnection Agreement (due to an Emergency, event of Force Majeure or other problem beyond the Point of Delivery), provided that the disconnection is not caused by actions of Seller or problems with the Facility; Company’s scheduling and other market participation activities, including any energy offer made by Company with respect to the Facility; and an election by Company to utilize non-firm transmission service to transmit Renewable Energy from the Point of Delivery to its load, and such non-firm transmission service is restricted or reduced by the applicable transmission service provider, except as provided in paragraph 2(iii) below.
Compensable Curtailment means a curtailment of generation or delivery of Solar Energy following COD arising out of the following (and only the following): a curtailment of the Solar Units by Company under Section 8.3(A) ; disconnection of the Solar Units from the Transmission Authority’s System pursuant to the Interconnection Agreement (due to an Emergency, event of Force Majeure or other problem beyond the Point of Delivery), provided that the disconnection is not caused by actions of Seller or problems with the Solar Units; Company’s scheduling and other market participation activities, including any energy offer made by Company with respect to the Solar Units; and an election by Company to utilize non-firm transmission service to transmit Solar Energy from the Point of Delivery to its load, and such non-firm transmission service is restricted or reduced by the applicable transmission service provider, except as provided in paragraph 2(iii) below.
