Consumer Loan Documents definition

Consumer Loan Documents means the promissory note, and such other instruments, documents and agreements (including any security agreement) entered into, evidencing or executed in connection with a Consumer Loan.
Consumer Loan Documents means all promissory notes, chattel paper, retail installment contracts, security agreements or other similar documents, agreements, instruments and writings evidencing or securing an Existing Receivable which have been executed by an Account Debtor or any guarantor of the related Existing Receivable and are payable to, or in favor of, a Borrower.
Consumer Loan Documents means all Consumer Loan accounts, documents, files, pawn tickets, buy-sell or repurchase agreements, layaway contracts, loan documents, loan contracts, loan applications, loan files, customer checks, promissory notes, promises to pay, certificates of title, security agreements, sales receipts, store credit receipts and vouchers, consignment contracts and other evidences of indebtedness or evidences of accounts receivable reflected by Seller's books and records as owed to and owned by Seller.

Examples of Consumer Loan Documents in a sentence

  • The Borrower shall have delivered the Required Consumer Loan Documents at the time when the loan is or was pledged as Collateral.

  • All consumer loans delivered by the Borrower to the Agent or the Collateral Custodian shall be accompanied by the Required Consumer Loan Documents, and the Borrower shall be deemed to represent and warrant in connection with all such loans delivered to the Agent or the Collateral Custodian that the certifications required to be included in the Consumer Loan Cover Sheet are true even if no such cover sheet shall be delivered by the Borrower.

  • All of the Required Consumer Loan Documents shall be the legal, valid and binding obligations of the consumer borrower, in full force and effect and enforceable in accordance with their terms, with no claim of defense, setoff or counterclaim asserted by the consumer borrower.

  • See clause (6) of the definition of "Required Consumer Loan Documents".

  • The Custodians shall have received the applicable Consumer Loan Documents and all other documents, instruments and writings required to be delivered to the Custodians hereunder and under the Custodian Agreements and Administrative Agent shall have received the Custodial Certificate from the Custodians relating thereto.

  • The Borrower shall promptly deliver to the Agent or the Collateral Custodian any additional documents related to any Consumer Loan Collateral which the Borrower acquires after delivery to the Agent or the Collateral Custodian of the Required Consumer Loan Documents.

  • Each Borrower hereby collaterally assigns to Lender, all of such Borrower’s right and title to and interest in, to and under (but not any obligations under) the Consumer Loan Documents, Consumer Lease Documents and each Auto Title related to each Existing Receivable, each RTO Receivable and all other agreements, documents and instruments related to any of the foregoing (collectively, the “Assigned Documents”).

  • All Consumer Loan Documents represent bona fide assets of Seller and bona fide transactions between Seller and the respective parties to such transactions.

  • Except for the Customer Service Policies described on Schedule 2.23 and except for the express terms of the Consumer Loan Documents, Seller is not liable to any customer of the Business for any customer reward, layaway, store credit, refund, exchange, merchandise warranty (express or implied), or any other customer benefits or customer service type programs.

  • Each Borrower hereby collaterally assigns to the Administrative Agent and Additional Collateral Agent, in each case for the benefit of the Lender Parties, all of such Borrower’s right and title to and interest in, to and under (but not any obligations under) the Consumer Loan Documents and each Auto Title related to each Receivable and all other agreements, documents and instruments related to any of the foregoing (collectively, the “Assigned Documents”).

Related to Consumer Loan Documents

  • Consumer loan means a loan to one or more individuals for household, fam- ily, or other personal expenditures. A consumer loan does not include a home mortgage, small business, or small farm loan. Consumer loans include the following categories of loans:

  • Consumer Loans means Loans to individuals for household, family and other personal expenditures (including United States and/or State-guaranteed student loans and extensions of credit pursuant to a credit card plan or debit card plan).

  • Consumer debtor means a debtor in a consumer transaction.

  • DIP Loan Documents means the Replacement DIP Loan Documents (as defined in the DIP Order).

  • Severed Loan Documents shall have the meaning set forth in Section 8.2(c) hereof.

  • Senior Loan Documents means the loan agreement between Borrower and Senior Creditor and any other agreement, security agreement, document, promissory note, UCC financing statement, or instrument executed by Borrower in favor of Senior Creditor pursuant to or in connection with the Senior Debt or the loan agreement, as the same may from time to time be amended, modified, supplemented, extended, renewed, restated or replaced.

  • Required Loan Documents means, for each Loan:

  • Prepetition Loan Documents means the “Loan Documents” as defined in the Prepetition Credit Agreement.

  • ABL Loan Documents means the “Loan Documents” as defined in the ABL Credit Agreement.

  • Borrower Loan Documents shall have the meaning given such term in the Borrower Loan Agreement.

  • Mortgage Loan Documents means, with respect to the Mortgage Loan, the Mortgage Loan Agreement, the Mortgage, the Notes and all other documents now or hereafter evidencing and securing the Mortgage Loan.

  • Bridge Loan Documents means the “Loan Documents” as defined in the Bridge Credit Agreement.

  • Second Lien Loan Documents means the “Loan Documents” as defined in the Second Lien Credit Agreement.

  • Original Loan Documents means the "Loan Documents" as defined in the Original Credit Agreement.

  • Existing Loan Documents has the meaning given to the term “Loan Documents” in the Existing Credit Agreement.

  • First Lien Loan Documents means the “Loan Documents” as defined in the First Lien Credit Agreement.

  • Subordinated Loan Documents means the Subordinated Credit Agreement, the promissory notes executed and delivered pursuant to the Subordinated Credit Agreement, and each other agreement, instrument, or document executed by the Borrower or any of its Subsidiaries or any of their Responsible Officers in connection with the Subordinated Credit Agreement.

  • Loan Documents means, collectively, this Agreement, any note or notes executed by Borrower, and any other document, instrument or agreement entered into in connection with this Agreement, all as amended or extended from time to time.

  • Term Loan Documents means the “Loan Documents” as defined in the Term Loan Agreement.

  • Credit Agreement Documents means the collective reference to any Credit Agreement, any notes issued pursuant thereto and the guarantees thereof, and the collateral documents relating thereto, as amended, supplemented, restated, renewed, refunded, replaced (whether or not upon termination, and whether with the original lenders or otherwise), restructured, repaid, refinanced or otherwise modified, in whole or in part, from time to time.

  • Cooperative Loan Documents As to any Cooperative Loan, (i) the Cooperative Shares, together with a stock power in blank; (ii) the original executed Security Agreement and the assignment of the Security Agreement endorsed in blank; (iii) the original executed Proprietary Lease and the assignment of the Proprietary Lease endorsed in blank; (iv) the original executed Recognition Agreement and the assignment of the Recognition Agreement (or a blanket assignment of all Recognition Agreements) endorsed in blank; (v) the executed UCC-1 financing statement with evidence of recording thereon, which has been filed in all places required to perfect the security interest in the Cooperative Shares and the Proprietary Lease; and (vi) executed UCC-3 financing statements (or copies thereof) or other appropriate UCC financing statements required by state law, evidencing a complete and unbroken line from the mortgagee to the Trustee with evidence of recording thereon (or in a form suitable for recordation).

  • Mezzanine Loan Documents means the “Loan Documents” as defined in the Mezzanine Loan Agreement.

  • Funding Loan Documents means (i) this Funding Loan Agreement, (ii) the Borrower Loan Agreement, (iii) the Regulatory Agreement, (iv) the Tax Certificate, (v) the Borrower Loan Documents, (vi) all other documents evidencing, securing, governing or otherwise pertaining to the Funding Loan, and (vii) all amendments, modifications, renewals and substitutions of any of the foregoing.

  • Senior Credit Documents means the collective reference to the Credit Agreement, the notes issued pursuant thereto and the guarantees thereof, and the collateral documents relating thereto, as amended, supplemented or otherwise modified from time to time.

  • Credit Documents mean the agreements, instruments, certificates or other documents at any time evidencing or otherwise relating to, governing or executed in connection with or as security for, a Loan, including without limitation notes, bonds, loan agreements, letter of credit applications, lease financing contracts, banker's acceptances, drafts, interest protection agreements, currency exchange agreements, repurchase agreements, reverse repurchase agreements, guarantees, deeds of trust, mortgages, assignments, security agreements, pledges, subordination or priority agreements, lien priority agreements, undertakings, security instruments, certificates, documents, legal opinions, participation agreements and intercreditor agreements, and all amendments, modifications, renewals, extensions, rearrangements, and substitutions with respect to any of the foregoing.

  • Australian Consumer Law means the law as set out in Schedule 2 of the Competition and Consumer Act 2010 (Cth).
