Court Duty. Section 1. After due notice to the EMPLOYER, employees subpoenaed to serve as a witness in cases arising from or during the performance of their official duties, or called and selected for jury duty, shall be allowed their regular compensation at their current BASE PAY RATE for the period the court duty requires their absence from work duty, plus any expenses paid by the court. Such employees, so compensated, shall not be eligible to retain jury duty pay or witness fees and shall turn any such pay or fees received over to the EMPLOYER. If an employee is excused from jury duty prior to the end of their work shift, they shall return to work as directed by the EMPLOYER or make arrangement for a LEAVE OF ABSENCE. Section 2. Any absence, whether voluntary or by legal order to appear or testify in private litigation, not in the status of an employee but as a plaintiff or defendant, shall not qualify for leave under this Article and shall be charged against accumulated leave or be without pay.

Court Duty. An employee on authorized vacation leave who is required to testify or is subpoenaed as a witness to give evidence on behalf of the Employer shall have his/her vacation leave entitlement restored for the periods of time required to attend court or any legal proceeding and will, in addition, for the hours so required to attend will receive twice his/her regular or normal salary.
Court Duty. Should an employee be required on his or her regular work day to report for jury duty or is subpoenaed to testify before a court of law, coroner's inquest, Parliamentary Inquiry or Royal Commission, the employee will be paid his or her regular salary for the day. Any reimbursement received from the court will be signed over to the Employer. An employee will not be entitled to any pay under this article if he or she is a party or principal in any of the aforementioned proceedings unless a party or principal as the result of performing the employee's duties for the Employer.
Court Duty. An Employee who is subpoenaed by the Crown for jury duty or as witness for the Crown or as a witness in any matter arising out of employment with the Employer, shall not lose any pay because of such service, provided the amount paid for such service is promptly repaid by the Employee to the Employer. The Employee must present proof of service and shall notify the Employer immediately upon the receipt of notification that the Employee has been subpoenaed by the Crown.
Court Duty. 25.01 The Company agrees to make up the difference between the Employee’s regular wages and remuneration received by such Employee subpoenaed as a Witness or called to serve on a Jury Panel.
Court Duty. (a) If an employee is required to attend Court for reasons arising out of the normal performance of the employee’s duties, time for the attendance that falls outside the employee’s regular hours of work will be paid as per Article 10.03
Court Duty. Off-duty employees will be paid for a minimum of three (3) hours or the time actually worked at their regular rate of pay while serving as a witness for a duty related matter as a representative of the County in response to a subpoena(s). All witness fees for paid court appearances shall be turned over to the County, along with travel reimbursements if the County has provided the employee a County vehicle for travel to the court session. Should an employee be required to respond to a subpoena outside of Pershing County, the employee may elect to utilize a personal vehicle and retain all witness fees and expenses paid in lieu of payment of the three (3) hour minimum. There shall be no overlapping minimum payment periods pursuant to this section.

Court Duty. Any teacher who is called for jury duty or court witness shall receive the necessary leave to fulfill his/her civic obligation. The teacher shall be paid his/her full salary for each contract day of absence provided that the teacher pays to the school corporation the compensation received for jury duty less mileage expense. The leave shall not be deducted from sick leave or from personal business leave days.
Court Duty. The Employer agrees that an Employee serving jury duty or subpoenaed as a witness for a work-related matter will suffer no loss of salary or benefits as long as the time from the job is in compliance with the summons or subpoena. All hours served on jury duty will be counted as hours worked, provided it occurs on an Employee’s regularly scheduled workday. Fees paid to an Employee for court duty or other related fees, except mileage and per diem, received by the Employee in connection with an absence granted under this section will be promptly returned to the Borough’s Finance Department. This leave is considered administrative leave and shall not be deducted from an Employee’s personal leave account.

Pay received for court duty must be given to the County by the employee. Pay for the expenses may be kept by the employee.
