Seller may reduce Contract Capacity without the notice prescribed in Section 9.1.2.6(a), provided that Seller shall refund to Edison the amount specified in Section 9.1.2.6(b) and an amount equal to: (i) the amount of Contract Capacity being reduced, times (ii) the difference between the Current Capacity Price and the Contract Capacity Price, times (iii) the number of years and fractions thereof (not less than one year) by which the Seller has been deficient in giving prescribed notice.
If the Current Capacity Price is less than the Contract Capacity Price, only payment under Section 9.1.2.6(b) shall be due to Edison.
