Designated Builder definition

Designated Builder means any Builder that is designated by Declarant as a “Designated Builder” in a supplemental declaration or in a written notice given by Declarant to the Association and by such designation receives certain rights as expressly provided in this Declaration.
Designated Builder means any legal entity other than Owner(s) that owns any parcel of real property within the Community, whether prior to or after the Effective Date, provided that such entity is designated as such by Master Developer to City Manager in writing. For purposes of the Applicable Rules, the term "Designated Builder" is intended to differentiate between the Master Developer, Owner(s) and their Affiliates in their capacity as developer and land owner and any other entity that engages in the development of a structure or other improvements on a Development Parcel(s) within the Community. A Designated Builder is not a Party to this Agreement and may not enforce any provisions herein, but upon execution and recordation of this Agreement, a Designated Builder may rely on and be subject to the land use entitlements provided for herein. Examples of Designated Builder in a sentence

  • The provisions of this Section shall not apply to any activity of Declarant or any Designated Builder or their respective employees, agents, or contractors during the course of construction activities or sales activities upon or about the Property.

  • Any actions taken by a Designated Builder pursuant to this Section shall require the prior approval of Declarant, which shall not be unreasonably withheld.

  • The provisions of this Section 5.16 shall not apply to any Declarant’s or any Designated Builder’s use of Lots owned by (or leased to) a Declarant or a Designated Builder, as applicable, as a model home or for marketing purposes.

  • Except as initially installed by the Declarant or a Designated Builder, no heating, air conditioning, or evaporative cooling unit shall be placed, constructed or maintained upon any Lot without the prior written approval of the New Construction Committee or Architectural Committee, as applicable.

More Definitions of Designated Builder

Designated Builder means any Person who (i) is engaged in the business of constructing and selling residences in the Property to the public, (ii) has acquired one or more Lots in connection with and in the course of such business, and (iii) is designated by Declarant in a Recorded instrument as a Designated Builder entitled to enjoy the rights and privileges provided to Designated Builders under this Declaration. The term "Designated Builder" shall also include any Person to whom all of the Designated Builder's rights and privileges hereunder are assigned by Recorded instrument, but only if Declarant's written consent to the assignment is either included in the Recorded instrument of assignment or is evidenced by separate Recorded instrument signed by Declarant.

A Designated Builder is not a Party to this Agreement and may not enforce any provisions herein, but upon execution and recordation of this Agreement, a Designated Builder may rely on the land use entitlements provided herein.
