Disabled dependent definition

Disabled dependent means a qualifying child or relative, as defined by the Internal Revenue Service, determined to be disabled, or who has a pending determination, by:
Disabled dependent means any unmarried child 26 years of age or older who is incapable of self-support due to a physical handicap, developmental disability, mental retardation or mental illness, provided such child (1) becomes so incapable prior to age 26, (2) was covered prior to attainment of such age and (3) is primarily dependent upon the covered employee for support and maintenance as of the date on which coverage would otherwise end. Written certification of the incapacity and continuing dependence from the dependent’s treating physician must be provided to the Plan Administrator within 30 days after the date that coverage for the dependent would normally end. Coverage under the Plan may be continued for as long as the incapacity and dependency continue, subject to periodic review by the Plan Administrator or until such coverage would otherwise end under the terms of the Plan (such as when the covered employee’s coverage ends, the disabled dependent is deemed permanently disabled and eligible for Medicare or when the covered employee is no longer primarily responsible for the disabled dependents primary support and maintenance). The Plan Administrator reserves the right to have such dependent examined by a Physician of the Plan Administrator's choice, at the Plan's expense, todetermine the existence of such incapacity.
