Environmental Contaminant definition

Environmental Contaminant means Hazardous Materials, or any other pollutants, contaminants, toxic or constituent substances or waste radioactive substances, materials or special wastes, polychlorinated bi-phenals, or any other substance or material, in each case regulated by applicable Environmental Laws;
Environmental Contaminant means any substance (whether a solid, liquid, gas and whether or not combined with any one or more other substances), activity or other phenomenon that is capable of causing harm to man or any other living organism supported by the environment, or damaging the environment or public health.
Environmental Contaminant means Hazardous Materials, or any other pollutants, contaminants, toxic or constituent substances or waste radioactive substances, materials or special wastes, petroleum or petroleum products, polychlorinated biphenyls, asbestos containing materials, or any other substance or material, in each case regulated by applicable Environmental Laws;

Examples of Environmental Contaminant in a sentence

  • In the event that there is any Environmental Contaminant in the Premises, the Building, or on the Lands, which is not handled in accordance with Section 5.13 of this Lease, the Tenant may terminate this Lease if the Landlord is unwilling or unable to cleanup or decommission such within a reasonable time of becoming aware of such Environmental Contaminant.

  • If any such Environmental Contaminant is not removed forthwith by the Licensor, the Licensee shall be entitled, but not required, to remove the same on the Licensor’s behalf, and the Licensor shall reimburse the Licensee for the cost thereof.

  • The Licensee shall use its continuing effort throughout the Term and any extension thereof to ensure that no part of the Lands is used to generate, manufacture, refine, treat, transport, store, handle, dispose of, transfer or produce any Environmental Contaminant onto the Lands.

  • The Tenant's termination of this Lease by reason of the Landlord failing or being unwilling to clean up the Environmental Contaminant shall be without prejudice to the Tenant's right to claim for damages against the Landlord arising out of such failure or refusal as aforesaid.

  • If the Tests reveal the existence of any Environmental Contaminant in, under, on or about the Premises, the Building or the Lands, Landlord shall promptly comply with its obligations under Section 5.14.


More Definitions of Environmental Contaminant

Environmental Contaminant means a substance the source of which is environmental and not the direct or indirect use of a chemical product;
Environmental Contaminant means any hazardous or toxic substance or material including, without limitation, products of waste, contaminants, pollutants, dangerous substances, noxious substances, toxic substances, hazardous wastes and flammable, explosive or improperly handled friable materials.
Environmental Contaminant means (a) any substance which, when it exists in the building or the water supplied to or in the building, or when it is released into the building or any part thereof, or into the water or the natural environment, is likely to cause at any time material harm or degradation to the building or any part thereof, or to the natural environment or material risk to human health, and includes, without limitation, any flammables, radioactive materials, asbestos, lead paint, PCBs, fungal contaminants (including without limitation and by way of example stachybotrys chartarum and other moulds), mercury and its compounds, dioxams and furans, chlordane (DDT), polychlorinated biphenyls, chlorofluorocarbons (CFCs), hydro- chlorofluorocarbons (HCFCs), volatile organic compounds (VOCs), urea formaldehyde foam insulation, radon gas, chemicals known to cause cancer or reproductive toxicity, pollutants, contaminants, hazardous wastes, toxic or noxious substances or related materials, petroleum and petroleum products, or (b) any substance declared to be hazardous or toxic under any environmental laws now or hereafter enacted or promulgated by any authorities, or (c) both (a) and (b).
Environmental Contaminant means any substance, activity, condition or other phenomenon the existence of which gives rise or could reasonably be expected, if any action were taken by any governmental agency or third party, to give rise to any notification, control, restriction, consent or other regulation or liability, sanction, order, notice or any requirement or agreed course of action under or arising out of the purported exercise by such government agency of its powers, duties and functions under Environmental Law (but excluding any petroleum products and related sediment and water received, stored or produced on or transported from, and any other consumables brought on to, the site of any property in each case in the ordinary course of business and provided that they are stored, received, produced, transported, consumed and/or used in accordance with good oilfield practice and with applicable Environmental Laws);
Environmental Contaminant means any substance, activity, condition or other phenomenon, the existence of which gives rise or could reasonably be expected, if any action were taken by any governmental agency or third party, to give rise to any notification, control, restriction, consent or other regulation or liability, sanction, order, notice or any requirement or agreed course of action under or arising out of the purported exercise by such government agency of its powers, duties and functions under Environmental Law (but excluding any substance naturally occurring on the relevant Property and any petroleum products and related sediment and water received, stored or produced on or transported from, and any other consumables brought on to, the site of any of the Properties, in each case, in the ordinary course of business and provided that they are stored, received, produced, transported, consumed and/or used in accordance with good mining practice and with applicable Environmental Laws); and “Environmental Laws” means all applicable laws, treaties, conventions, statutes, ordinances, by-laws, regulations, orders, directives and decisions rendered by any local, state or federal government, ministry, department or administrative or regulatory agency relating to the protection of the environment, occupational health and safety or the processing, use, treatment, storage, disposal, discharge, transport or handling of any pollutants, contaminants, chemicals or industrial, toxic or hazardous wastes or substances.
Environmental Contaminant means a substance the presence of which in soil, sediment, groundwater, air or otherwise is prohibited by, or the quantity or concentration of which exceeds, prescribed criteria, standards or conditions set out in Environmental Laws;
Environmental Contaminant means any physical, chemical, biological or radiological substance having an adverse effect on the environment, which has been released into the environment and whose concentration exceeds the greater of naturally occurring background levels or applicable regulations or guidelines.
