Examples of Equivalent Product in a sentence
This Agreement is entered into as of the date of signing and, unless earlier terminated pursuant to Section 20, shall continue in full force and effect until the longer of (a) 15 years after the date of the First Commercial Sale of the Product in the Territory, (b) the commercial introduction of an Equivalent Product (as such term is defined in Section 1.25, above) to the Product in the Territory, or (c) the expiration of the last to expire of the Patents.
If a Generic Equivalent Product is sold commercially in the Territory and then subsequently withdrawn, with no other Generic Equivalent Product being sold commercially in the Territory, then Vertical will, in good faith and without undue delay, once again comply with the foregoing Minimum Promotion Commitment as soon as is it practical to do so.
Materials and Products Specified by Naming Products of One or More Manufacturers with a Provision for an Equivalent Product: Submit one of the products listed which complies with specified requirements or submit a request for substitution for a product of manufacturer not specifically named which complies with specified requirements.
Vertical agrees to do so only when Vertical believes in good faith, based upon credible market information, that a Generic Equivalent Product is on, or is expected to shortly come into, the market in the Territory.
For the avoidance of doubt, no license is granted hereby to use the Trademark in connection with any Equivalent Product.
