Excluded Materials definition

Excluded Materials means any refined petroleum products other than those that are Products.
Excluded Materials means any appraisals, internal reports, valuations, other offers or agreements relating to the acquisition or sale of the Property, economic evaluations of the Property, reports regarding the Property prepared by Seller or any affiliate of Seller for the internal use or for the information of the investors in Seller, privileged information, information related to Seller’s previous loans in connection with the Property, and any other proprietary information not relating to the physical or environmental condition of the Property. By executing this Agreement, Buyer acknowledges that it has no right to review any of the Excluded Materials.
Excluded Materials means: i) Supplier’s Pre-Existing Materials; ii) Supplier’s Independently Developed Materials; and iii) Supplier’s Mere Reconfigurations.

Examples of Excluded Materials in a sentence

  • Title to and liability for Excluded Materials shall remain with Customer at all times.

  • The materials and activities listed in the foregoing sentence are hereinafter referred to as "Excluded Materials and Activities".

  • In the event ESCO discovers Hazardous or Excluded Materials, ESCO will immediately cease Work, remove all ESCO personnel or subcontractors from the site, and notify the Customer.

  • Paid-For Development shall always exclude all Excluded Materials, but shall include (without limitation) any modifications, alterations or updates of any Excluded Materials (“Enhancements”) that otherwise fall within the definition of Paid-For Development (“Paid-For Enhancements”).

  • Without limiting the foregoing, Customer shall pay a contamination charge for additional handling, processing, transporting and/or disposing of such non-conforming Recyclable Materials, Special Waste, Excluded Materials, and/or all of part of non-conforming loads and additional charges may be assessed for bulky items such as appliances, concrete, furniture, mattresses, tires, electronics, pallets, yard waste, propane tanks, etc.


More Definitions of Excluded Materials

Excluded Materials means: i) Contractor’s Pre-Existing Materials; ii) Contractor’s Independently Developed Materials; and iii) Contractor’s Mere Reconfigurations.
Excluded Materials means radioactive, volatile, corrosive, flammable, explosive, biomedical, infectious, bio-hazardous or toxic substance or material, or regulated medical or hazardous waste as defined by, characterized or listed under applicable federal, state, or local laws or regulations, materials containing information (in hard copy or electronic format, or otherwise) which information is protected or regulated under any local, state or federal privacy or data security laws, including, but not limited to the Health Insurance Portability and Accountability Act of 1996, as amended, or other regulations or ordinances.
Excluded Materials means: i) Radcom’s Pre-Existing Materials; ii) Radcom’s Independently Developed Materials; and iii) Radcom’s Mere Reconfigurations
Excluded Materials means: [i] Client’s Pre-Existing Materials; [ii] Client’s Independently Developed Materials; and [iii] Client’s Mere Reconfigurations.
Excluded Materials means (x) Hazardous Materials, other than asbestos containing materials, which may be present in lawful amounts and stored in accordance with applicable Laws as components of paints (excluding lead-based paints), glues, fuels, photocopy equipment supplies, janitorial supplies, cleaning agents and solvents in quantities commonly stored, found or maintained for similar uses in retail shopping centers similar to the Buildings, and (y) mastic containing asbestos and asbestos containing materials in floor tile that are not friable.
Excluded Materials shall have the meaning ascribed in Section 3.2.3.
Excluded Materials means, with respect to the Portfolio, any and all documents, notes, correspondence (including electronic mail or other correspondence) or other writings that relate to the Portfolio and that the Seller reasonably and in good faith determines (i) are subject to the attorney-client privilege or work product doctrine or other evidentiary privilege in favor of the Seller, (ii) are proprietary to the Seller's business (including the methodology or basis for formulation of the Seller's internal risk rating profiles for the Customers or any Guarantors), or (iii) comments upon the character, talent or abilities of any Person employed by or on behalf of any Customer, Guarantor or other obligor under any of the Portfolio Documents.
