The Optionor will, as soon as is practicable after the Effective Date, deliver to the Optionee copies of the Exploration Data which it has in its physical possession, and will cause to be made available at its then present location, any Exploration Data which is not then in the physical possession of the Optionor.
Each Party shall execute such documents, render all necessary assistance as the other Party (or its Affiliates) may reasonably request, at the other Party’s expense, to obtain, prosecute, perfect, maintain the rights in and to such other Party’s interest in such Exploration Data and Record or Alliance IP.
Exploration Data is provided ‘as is’ and without any warranty or condition express or implied, statutory or otherwise as to its quality or fitness for purpose.
For the avoidance of doubt, the Exploration Data shall be treated as confidential information and disclosure of the data catalogue and the metadata to the Geospatial Commission shall be expressly permitted by the Licensor.
On the early termination or expiry of this Licence, the Licensee shall: ● immediately cease using the Exploration Data; ● destroy (or at the Licensor’s option return) all Exploration Data under this Licence that it holds or for which it is responsible and provide written confirmation that it has done so at the Licensor’s request.
Other Substantive Exploration Data Other exploration data, if meaningful and material, should be reported including (but not limited to): geological observations; geophysical survey results; geochemical survey results; bulk samples – size and method of treatment; metallurgical test results; bulk density, groundwater, geotechnical and rock characteristics; potential deleterious or contaminating substances.
The NRC will provide the Contractor one copy of the report entitled " Interpretation Report on the Aeromagnetic Coverage of the Skagit Nuclear Power Project" by Exploration Data Consultants, Inc.
Subject to Section 13, each Party will be entitled to retain a copy of all Exploration Data and other information provided to it in respect of a New Project.
For the avoidance of doubt, Exploration Data provided under this Licence shall not be uploaded to the NUAR platform.
