FERC Application definition

FERC Application means an application under FPA Section 203 or a petition for declaratory order seeking a determination by FERC that the Common Units are passive, non-voting securities for purposes of FPA Section 203 such that the acquisition of Common Units by an acquiror in any amount will not result, directly or indirectly, in a change of control or merger or consolidation with respect to the Partnership’s direct or indirect public utility subsidiaries or otherwise require separate authorization pursuant to FPA Section 203.
FERC Application means the document pursuant to which application for a certificate(s) of public convenience and necessity is made under Section 7 of the NGA to the FERC by the Company for authority to construct, own, acquire, and operate, and provide service on the Facilities.
FERC Application has the meaning given in Section 2.3(a).

More Definitions of FERC Application

FERC Application means the documents pursuant to which application for authorization is made to the FERC by the Company and SLNG for authority to construct and install the ELC Facilities and to make any necessary modifications to the SLNG Facilities at the Xxxx Terminal to accommodate the construction, installation and operation of the ELC Facilities and the Export Operations. The FERC Application shall seek authority to operate the ELC Facilities under Section 3 of the Natural Gas Act on an unregulated basis in accordance with the Energy Policy Act of 2005.
FERC Application means that certain application (as amended from time to time), filed by SABINE with the FERC on December 22, 2003 in docket No. CP04-47-000 in relation to the Sabine Pass Facility pursuant to Section 3(a) of the Natural Gas Act (“NGA”) and the corresponding regulations of the FERC.
FERC Application means the Application of the Initial Borrower and certain of its Affiliates filed with the Federal Energy Regulatory Commission on March 13, 2007.
