Fiscal Year Compensation definition

Fiscal Year Compensation means Compensation relating to a period of service coextensive with one or more consecutive non-calendar-year fiscal years of the Employer, where no amount of such Compensation is paid or payable during the service period. For example, a Bonus based upon a service period of two consecutive fiscal years payable after the completion of the second fiscal year would be “Fiscal Year Compensation,” but periodic salary payments or Bonuses based on service periods other than the Employer’s fiscal year would not be Fiscal Year Compensation.
Fiscal Year Compensation means that in the case where the Plan Sponsor’s taxable year is a non-calendar year, a Participant may elect to defer Bonus Compensation by making an election no later than the close of the Plan Sponsor’s taxable year which precedes the Plan Sponsor’s taxable year in which the Participant performs services for which the Compensation is payable. Fiscal Year Compensation includes Compensation relating to a period of service coextensive with one or more consecutive taxable years of the Plan Sponsor, of which no amount is paid or payable during the Plan Sponsor’s taxable year or years constituting the period of service in accordance with Treasury Regulation §1.409A-2(a)(6) and Applicable Guidance.
Fiscal Year Compensation means “fiscal year compensation” as defined under Section 409A of the Code, relating to a period of service that is coextensive with one or more consecutive taxable years of any Employer of which no amount is paid or payable during the taxable year(s) of the Associate or Participant constituting the period of service.
