Hudud definition

Hudud means punishment prescribed by Allah or Hadith;
Hudud means a specific punishment prescribed by God for crimes which transgress upon God/social rights. Hudud crimes are: Slander, Zena (fornication or adultery), Apostasy, Baghee (unlawful rebellious acts), Voluntary Intoxication, Hiraba (major crimes against public order and safety typically exemplified in terms of armed highway robbery), and Theft. The crime of Apostasy is debatable; See MOHAMMED S. EL-AWA, PUNISHMENT IN ISLAMIC LAW 53-6 (Plainfield: American Trust Publications, 2000).

Examples of Hudud in a sentence

  • Hudud constitutes crimes against divine will, the applicable punishments for which include the death penalty, crucifixion, stoning, amputation of the right hand and, for repeat offences, the left foot, flogging, imprisonment and exile.

  • Under Shari’ah, the penalties for Hudud, plural for Hadd (capital crime) which are seen as crimes against Allah (God) and Qisas, which are crimes against persons, are imposed in the Qur’an.

  • One view is that they should not be as severe as those for Hudud.

  • Imam Al-Shafi explained this when he was asked, “[d]o you view the ruler, if he imposes a penalty similar to the death penalty, as departing from the Sunnah of the Prophet?” Imam Al-Shafi said, “Tazir are different from Hudud.

  • Hudud (Punishment): Hudud punishments are fixed in the Qur’an and Hadith and are unquestionably obligatory in Islamic Law.

  • Another is that Tazir penalties should not reach the minimum level of Hudud punishments, such as forty or eighty lashes.


More Definitions of Hudud

Hudud means offences or punishments that are fixed under the Sharia and includes offences or punishments in Section 57 of Sharia Penal Code;116‘qisas” means punishments inflicted upon the offenders by way of retaliation for causing death of or injuries to a person;117[“mukallaf”]118 103 Bauchi: “‘Investigation’ means and shall include all proceedings under chapter XII of the Criminal Procedure Code Law Cap 38 laws of the Bauchi State of Nigeria 1991 or Section 149 thereof for the collection of evidence by the police but the trial proper must be conducted in accordance with Islamic law.”104 CPC: “of a justice of the peace or court”.105 CPC: “local limits of the administrative province, division or district or judicial division or magisterial district”. Jigawa: “local limits of the judicial division”.106 Jigawa omits everything after the word ‘functions’.107 CPC: “justice of the peace”. Gombe: “judge”.108 Borno: “the locality”.‌109 Bauchi omits the definition of ‘local limits of the jurisdiction’.110 CPC puts here a definition of ‘native court’: “a court established or deemed to have been established under the Native Courts Law”. In 1967-68 the Native Courts were transformed into Area Courts and this and other sections of CPC dealing with Native Courts were amended accordingly.111 CPC, Bauchi omit the definition of ‘Sharia Court of Appeal’.112 CPC has no similar definition. Gombe defines ‘judge’: “means a judge of any of the Sharia Courts”. Gombe then uses the word ‘judge’ throughout its SCPC, where the other SCPCs use ‘alkali’. This will not be separately noted subsequently.113 CPC, Bauchi omit the definition of ‘kadi’.114 CPC, Bauchi, Borno omit the definition of ‘state’.115 CPC, Bauchi omit the definition of ‘taklif’. Kaduna defines it as “the age of attaining legal and religious responsibility.” Kebbi and Sokoto add to Kaduna’s definition: “by both age and mental soundness”.116 CPC, Bauchi omit the definition of ‘hudud’. Gombe: “means offences or punishments that are fixed under the Sharia as contained in the Sharia Penal Code Law.”117 CPC, Bauchi omit the definition of ‘qisas’. Kaduna has “reciprocal punishment” instead of “retaliation”.118 Jigawa includes a definition of ‘mukallaf’: “means a competent person to stand trial”.
