Incidental Take Permit definition

Incidental Take Permit means a Permit issued under section 10(a)(1)(B) of the ESA to a non-federal party undertaking an otherwise lawful project that might result in the “take” of a threatened or endangered species. An application for an Incidental Take Permit is subject to certain requirements, including the preparation of a habitat conservation plan.

Incidental Take Permit or “ITP” means a permit authorizing Take of listed species incidental to otherwise lawful activities pursuant to section 10 of the FESA (16 U.S.C. 1539(a)(2)(B)).

Incidental Take Permit means the permit, effective as of February 1, 2001, issued by the Secretary of the Interior pursuant to Section 10(a)(1)(B) of the Federal Endangered Species Act of 1973, 16 U,S,C Section 1539 which incorporates by reference the Multiple Species Habitat Conservation Plan and Implementing Agreement and allows the incidental taking of Threatened or Endangered Species in the course of otherwise lawful activities.
