Service Provider will notify the Regulator of any proposed Surcharge to be levied on Users of Incremental Services and designed to recover non-conforming capital expenditure or a specified portion of non-conforming capital expenditure.
Users of Incremental Services which have not made capital contributions towards capacity investment needed to provide those Incremental Services which they use and which have been funded by others may be liable to pay a Surcharge as provided under Rule 83 of the National Gas Rules.
