Initial Settlement Payment definition

Initial Settlement Payment has the meaning set forth in section 6.2(c)(i).
Initial Settlement Payment means an amount of money equal to fifty- five percent (55%) of all Post-Production Costs reflected as deductions from Gas Royalty payments made by Chesapeake to Settlement Class Members under the Pennsylvania Leases prior to June 1, 2014.
Initial Settlement Payment means the payment of a sum certain required to be made by the Borrower to F-K in accordance with Paragraph 14 of the Settlement Agreement.

  • If the Secretary grants the ROWs, then on the day that all ROWs are granted and upon the Escrow Agent’s transfer of the Initial Settlement Payment to the Pueblo in accordance with Section 2(B)(i), the Department and the Pueblo shall irrevocably and forever release and discharge the County, former and current County employees, and former and current County elected officials from any and all claims of Trespass Damages.

  • The County shall pay the Pueblo $1,750,000.00 (“Initial Settlement Payment”), which Initial Settlement Payment shall be deposited with the Escrow Agent in accordance with Section 2(C) below.

  • In the event that there are Excluded Members who, when combined, would be allocated five percent (5%) or more of the Initial Settlement Payment, Defendant shall have the right, in its sole and absolute discretion, within twenty (20) calendar days after the opt-out deadline set by the Court, to notify Lead Class Counsel in writing that Defendant has elected to dissolve this Settlement Agreement and withdraw from the Settlement.

  • The Initial Settlement Payment, Monthly Settlement Payments, and Final Settlement Payment (collectively, the “Settlement Payment”) shall satisfy payment under this Agreement.

  • Once Plaintiffs have received the Initial Settlement Payment (defined below) from Defendants, they shall file with the Court a Stipulation of Dismissal with Prejudice and Retention of Jurisdiction, dismissing the Lawsuit in its entirety.

  • The Settlement Class Administrator shall make the Initial Settlement Payment to Settlement Class Members who submitted valid claim forms within 30 days following the Effective Date.

  • Individual Settlement Payment means the amount payable from the Net

  • Final Settlement means permanent settlement of the Contractor’s actual allowable costs or expenditures as determined at the time of audit, which shall be completed within three years of the date the year-end cost settlement report was accepted for interim settlement by the State. If the audit is not completed within three years, the interim settlement shall be considered as the final settlement.

  • Structured settlement payment rights means rights to receive periodic payments under a structured settlement, whether from the structured settlement obligor or the annuity issuer, where:

  • Cash Settlement Date means, for each Financially Settled Futures Transaction, the Business Day determined by Exchange from time to time in accordance with industry practice for such Transaction, as posted on Exchange’s Website not less than one month prior to the occurrence of such date, other than Invoices issued as a result of a Contracting Party’s Default or under the Close- out Procedure which amounts require payment immediately;

  • Viatical settlement broker means a person, including a life insurance producer as provided for in section 508E.3, who, working exclusively on behalf of a viator and for a fee, commission, or other valuable consideration, offers or attempts to negotiate viatical settlement contracts between a viator and one or more viatical settlement providers or one or more viatical settlement brokers. Notwithstanding the manner in which the viatical settlement broker is compensated, a viatical settlement broker is deemed to represent only the viator, and not the insurer or the viatical settlement provider, and owes a fiduciary duty to the viator to act according to the viator’s instructions and in the best interest of the viator. “Viatical settlement broker” does not include an attorney, certified public accountant, or a financial planner accredited by a nationally recognized accreditation agency who is retained to represent the viator and whose compensation is not paid directly or indirectly by the viatical settlement provider or purchaser.

  • Net Settlement Amount means the Gross Settlement Amount, less the following payments in the amounts approved by the Court: Individual PAGA Payments, the LWDA PAGA Payment, Class Representative Service Payment, Class Counsel Fees Payment, Class Counsel Litigation Expenses Payment, and the Administration Expenses Payment. The remainder is to be paid to Participating Class Members as Individual Class Payments.

  • Cash Settlement shall have the meaning specified in Section 14.02(a).

  • Physical Settlement Date means the date specified as such in any Physical Settlement Notice, which shall be not earlier than 10 nor later than 20 Business Days after the date on which the Physical Settlement Notice is given.

  • ASX Settlement means ASX Settlement Pty Ltd (ABN 49 008 504 532);

  • PJM Settlement or “PJM Settlement, Inc.” shall mean PJM Settlement, Inc. (or its successor), established by PJM as set forth in Operating Agreement, section 3.3.
