If there is no Consumer Price Index Increase (i.e., there is deflation during the relevant period), there shall be no reduction in the IRU Fee from the prior year.
Operator shall submit to Tacoma Power, as of the Effective Date, and on an annual basis on the Annual Reporting Date, a report in a form reasonably acceptable to Tacoma Power, demonstrating Operator’s financial health and Operator’s ability to pay the IRU Fee and all other ongoing financial obligations associated with this IRU Agreement.
