Lessor Personal Property definition

Lessor Personal Property means: (i) all personal property used in the operation or management of the Facilities, including machinery, equipment, furniture, furnishings, beds, computers, signage, trade fixtures or other personal property and consumable inventory and supplies, including any and all such personal property replaced by Lessee as set forth in the Lease, and (ii) all site plans, surveys, soil and substrata studies, architectural drawings, plans and specifications, engineering plans and studies, floor plans, landscape plans, and other plans and studies that relate to the Facilities; provided, however, that Lessor Personal Property shall not include: (a) any vehicles or computer software used in connection with the operation of the Facilities, or (b) any equipment Leased by Lessee from third parties, which equipment is not a replacement of what would otherwise be Lessor Personal Property. Lessor’s Personal Property as of the Execution Date shall include, without limitation, the items listed on the attached Schedule A-2. For purposes of this Lease, the following terms and words shall have the specified meanings:
Lessor Personal Property has the meaning assigned in Section 5.2(f) hereof.
Lessor Personal Property means: (i) all personal property used in the operation or management of the Facility, including machinery, equipment, furniture, furnishings, beds, computers, signage, trade fixtures or other personal property and consumable inventory and supplies, including any and all such personal property replaced by Lessee or required by the state in which the Facility is located or any other governmental entity to operate the Facility, and (ii) all site plans, surveys, soil and substrata studies, architectural drawings, plans and specifications, engineering plans and studies, floor plans, landscape plans, and other plans and studies that relate to the Facilities; provided, however, that Lessor Personal Property shall not include: (a) any vehicles or computer software used in connection with the operation of the Facilities, or (b) any equipment leased or subleased by Lessee from third parties, which equipment is not a replacement of what would otherwise be Lessor Personal Property. 36734458_7 For purposes of this Lease, the following terms and words shall have the specified meanings:

Examples of Lessor Personal Property in a sentence

  • At the end of the Term or upon the earlier termination of this Lease, Lessee shall return the Leased Property to Lessor with the Lessor Personal Property (or replacements thereof) in the same condition and utility as was delivered to Lessee at the commencement of the Term, reasonable and ordinary wear and tear excepted.

  • The Lessee further covenants and agrees that no Essential Lessor Personal Property will be removed or relocated without securing a replacement therefor.

  • As part of Lessee’s obligations under this Article 8, Lessee shall be responsible to maintain all Lessor Personal Property and all Lessee Personal Property in good condition, ordinary wear and tear excepted.

  • If Lessee is required or elects to restore the Leased Property, Lessee shall either (a) restore (i) all alterations and improvements made by Lessee, (ii) the Tangible Personal Property and (iii) Lessor' Personal Property or (b) replace such alterations and improvements, the Tangible Personal Property and Lessor's Personal Property with improvements or items of the same or better quality and utility in the operation of the Leased Property.

  • If any of Lessor Personal Property is replaced as a result of its (i) having been taken in condemnation, Lessee shall be entitled to that portion of any award made for the replaced property or (ii) having been lost, stolen, damaged, or destroyed, Lessee shall be entitled to that portion of any insurance proceeds paid with respect to the replaced property.

  • Without limiting the foregoing, the Lessee shall promptly upon such replacement or substitution deliver a bill xx sale or other similar evidence of title to the Lessor, and Lessor shall promptly deliver to the Lessee a release of any interest in any Lessor Personal Property so replaced by the Lessee.

  • The Lessee further covenants and agrees (notwithstanding clause (ii) of the first sentence of Section 5.4 hereof) to replace promptly any worn out or obsolete Lessor Personal Property with other personal property of similar value and use if the worn out or obsolete Lessor Personal Property is essential for the efficient or proper operation or maintenance of the Project Facilities for the Project Purposes in accordance herewith and as it is then being used (the "Essential Lessor Personal Property").

  • Lessee shall, at Lessee's sole expense, also maintain the Lessor Personal Property (including any personal property, equipment and/or supplies acquired after the Effective Date hereof which are used in the operation of the Hotel) in good condition and repair at all times, including, without limitation, to replace each item thereof with like quality property in the event of casualty or damage or because such item has reached the end of its useful life.

  • If no Event of Default shall have occurred and be continuing at the time, Lessee shall have the right in connection with the surrender of the Leased Property to remove from the Leased Property all Lessee Personal Property but not the Lessor Personal Property (including the Lessor Personal Property replaced by the Leased Property or required by the State of West Virginia or any other governmental entity to operate the Leased Property for its Primary Intended Use.

  • The proceeds of the sale of any replaced Lessor Personal Property shall be paid to Lessee and Lessee may trade in any worn out, obsolete or unusable replaced Lessor Personal Property on the purchase of any replacement property.

  • Leased Personal Property shall have the meaning given such term in Section 2.1(e).

  • Personal Property means any machinery, equipment, tools, vehicles, furniture, leasehold improvements, office equipment, plant, parts and other tangible personal property.

  • Tenant’s Personal Property means all motor vehicles, Inventories, FAS and any other tangible personal property of Tenant, if any, acquired by Tenant at its election and with its own funds on and after the date hereof and located at the Leased Property or used in Tenant's business at the Leased Property and all modifications, replacements, alterations and additions to such personal property installed at the expense of Tenant, other than any items included within the definition of Proprietary Information.

  • Excluded Personal Property means the following:

  • Rental Property means a hotel room, vacation home, or other rental property You booked for Your stay during Your Trip.

  • Leased Property shall have the meaning given such term in Section 2.1.

  • Additional Property means, in respect of a Series, the rights and benefits provided in respect of the Series, or applicable Class, pursuant to any letter of credit, surety bond, cash collateral account, spread account, guaranteed rate agreement, maturity liquidity facility, tax protection agreement, interest rate and/or currency swap agreement, loan agreement, enhancement agreement or other similar arrangement as contemplated under the Pooling and Servicing Agreement and as provided for in the related Series Purchase Agreement.

  • Personal Property Leases has the meaning set forth in Section 2.1(e).

  • Tenant’s Property means Removable Installations and, other than Installations, any personal property or equipment of Tenant that may be removed without material damage to the Premises, and (z) “Installations” means all property of any kind paid for by Landlord, all Alterations, all fixtures, and all partitions, hardware, built-in machinery, built-in casework and cabinets and other similar additions, equipment, property and improvements built into the Premises so as to become an integral part of the Premises, including, without limitation, fume hoods which penetrate the roof or plenum area, built-in cold rooms, built-in warm rooms, walk-in cold rooms, walk-in warm rooms, deionized water systems, glass washing equipment, autoclaves, chillers, built-in plumbing, electrical and mechanical equipment and systems, and any power generator and transfer switch.

  • Adjoining Property means all sidewalks, driveways, curbs, gores and vault spaces adjoining any of the Leased Premises.

  • Leaseholds of any Person shall mean all the right, title and interest of such Person as lessee or licensee in, to and under leases or licenses of land, improvements and/or fixtures.

  • Leased Assets shall have the meaning ascribed thereto in Section 3.6.

  • Existing Property means all property against which ad valorem property taxes were levied by a local unit for its concluding fiscal year, minus all property that is considered losses for purposes of ad valorem property tax levies of the local unit for the ensuing fiscal year.

  • Personalty means all of the following:

  • Mixed-use property means an eligible property that includes three or more residential units and may also contain a commercial property component in the same building.

  • Operating Property means any property owned, leased, or operated by the Party in question or by any of its Subsidiaries or in which such Party or Subsidiary holds a security interest or other interest (including an interest in a fiduciary capacity), and, where required by the context, includes the owner or operator of such property, but only with respect to such property.

  • Company Leased Real Property has the meaning set forth in Section 3.14(b).

  • Leased Real Property has the meaning set forth in Section 3.18(b).

  • Assisted cleaning or washing of tangible personal property means cleaning or washing of tangible personal property if the cleaning or washing labor is primarily performed by an individual:

  • Tangible Personal Property means, in respect of any Person, all machinery, equipment, tools, furniture, office equipment, supplies, materials, vehicles and other items of tangible personal or movable property (other than Inventories and IT Assets) of every kind and wherever located that are owned or leased by the Person, together with any express or implied warranty by the manufacturers, sellers or lessors of any item or component part thereof and all maintenance Records and other documents relating thereto.

  • Municipal Property means all property, including lands and buildings, owned, controlled or managed by the Municipality within the Municipal Service Area;

  • Eligible personal property means property that meets all of the following conditions:

  • Landlord Personal Property Collateral Access Agreement means a Landlord Waiver and Consent Agreement substantially in the form of Exhibit S, with such amendments, modifications or supplements as may be approved by Collateral Agent.

  • Property, Plant and Equipment means any item of real property, or any interest therein, buildings, improvements and machinery.

  • Residential rental property means property that is used solely as leased or rented property for residential purposes. If the property is a space rental mobile home park, residential rental property includes the rental space that is leased or rented by the owner of that rental space but does not include the mobile home or recreational vehicle that serves as the actual dwelling if the dwelling is owned and occupied by the tenant of the rental space and not by the owner of the rental space.

  • Personal Property Collateral means all Collateral other than Real Property.
