Millsite Operations definition

Millsite Operations means those activities that are conducted in or on the Permit Area pursuant to and in compliance with the Plan of Operations and the Reclamation Plan and that are normally and reasonably associated with a millsite, including but not limited to the following:
Millsite Operations means those activities that are conducted in or on the Millsite Area pursuant to and in compliance with the Plan of Operations, environmental systems management plans or other plans requested and approved by the Division, along with such activities reasonably associated therewith, which in this Project include but are not limited to the following:
Millsite Operations means those activities that are conducted in or on the Millsite Area pursuant to and in compliance with the Plan of Operations and the Reclamation Plan or other plans requested and approved by the Division, along with such activities that are normally and reasonably associated therewith, which in this Project include but are not limited to thefollowing: (1) Extracting, processing, storing, removing, transporting, and selling or otherwise disposing of locatable minerals mined pursuant to Mining Rights; (2) placing, constructing, erecting, installing, maintaining, repairing, using, replacing, and removing excavations, openings, ditches, drains, stockpiles, waste rock dumps, roads, haulage ways, buildings, structures, machinery, equipment, and other Facilities consistent with the Plan of Operations, on or below the surface of the Millsite Area, as may be reasonably necessary or desirable for the purpose of engaging in the activities described in Subsection 2.i.(1) above; (3) Reclamation activities in conformance with the provisions of this Lease and the Reclamation Plan; and (4) any and all other actions in or on the Millsite Area that may be reasonably necessary or desirable to carry on Millsite Operations, subject to the limitations and restrictions of any and all other leases, permits, authorizations, statutes, laws, regulations, and ordinances existing at the time of the action.

Examples of Millsite Operations in a sentence

  • Not later than 90 days after the permanent cessation or abandonment of Millsite Operations, Lessee shall notify the Division of the cessation of Millsite Operations.

  • Upon any conveyance of the Millsite Area by the State the provisions of AS 38.05 and 11 AAC that are in effect on the date of such conveyance and which govern the Lease and the conduct of Millsite Operations hereunder shall be deemed to be incorporated into this Lease as if fully set forth herein and shall continue to govern the administration, management, and operation of this Lease.

  • If a Temporary Closure extends beyond three (3) years, the Division may deem Millsite Operations to be permanently abandoned or ceased, and whereupon final Reclamation must commence unless otherwise agreed by the parties.

  • Such material may be used without charge only within and for the benefit of the Millsite Area and for or in connection with Millsite Operations.

  • During the term of this Lease, the Lessee may release and relinquish to the State at any time any State lands subject to this Lease that the Lessee determines are no longer necessary for the Lessee's Millsite Operations, by obtaining the Division's written concurrence described in this Section.

  • No Transfer permitted by this Section shall, as between the State and Lessee, relieve Lessee of any liability, whether accruing before or after such Transfer, which arises out of Millsite Operations conducted prior to such Transfer.

  • Unless otherwise provided in the Reclamation Plan, Lessee must reclaim land concurrently with the conduct of Millsite Operations.

  • The notice shall state the nature and reason for the Temporary Closure, the anticipated duration of the Temporary Closure, what actions will be taken to comply with Subsection 15(b), and any event which would reasonably be anticipated to result in the resumption or abandonment of Millsite Operations.

  • Millsite Operations must resume for not less than ninety (90) consecutive days in order to terminate the running of the Temporary Closure.

  • At any time upon the Division's written request, Lessee shall promptly make any and all records, documents, or other information required to be kept or maintained by law, regulation, or ordinance available to the Division for inspection and copying as reasonably required by the Division to determine Lessee's compliance with local, state, and federal laws applicable to Millsite Operations.

Millsite Operations means those activities that are conducted in or on the Millsite Area pursuant to and in compliance with the Plan of Operations, environmental systems management plans, project management system, or other plans requested and approved by the Division, along with such activities reasonably associated therewith, which in this Project include but are not limited to the following: i. processing, storing, removing, transporting, and selling or otherwise disposing of minerals mined pursuant to Mining Rights; ii. placing, constructing, erecting, installing, maintaining, repairing, using, replacing, and removing excavations, openings, ditches, drains, stockpiles, waste rock dumps, roads, haulageways, buildings, structures, machinery, equipment, and other Facilities at locations specified in the Plan of Operations, on or below the surface of the Millsite Area, as may be reasonably necessary or desirable for the purpose of engaging in the activities described in Subsection 2(i)(i) above; iii. reclaiming the Millsite Area in conformance with the provisions of this Lease and the Reclamation Plan; and iv. any and all other actions in or on the Millsite Area that may be reasonably necessary or desirable to carry on Millsite Operations, including temporary use of surface water run-off at the mine site to be used for dust control purposes within the Millsite Area, subject to the limitations and restrictions of any and all other leases, permits, authorizations, statutes, laws, regulations, and ordinances existing at the time of the action.

Related to Millsite Operations

  • Exploration Operations means any operations carried out for or in connection with the exploration for minerals, and includes -

  • Business operations means engaging in commerce in any form, including by acquiring, developing, maintaining, owning, selling, possessing, leasing, or operating equipment, facilities, personnel, products, services, personal property, real property, or any other apparatus of business or commerce.

  • Production Operations means all operations conducted for the purpose of producing Petroleum from the Development Area after the commencement of production from the Development Area including the operation and maintenance of all necessary facilities therefor.

  • Salvage operation means any business, trade or industry engaged in whole or in part in salvaging or reclaiming any product or material, including but not limited to metals, chemicals, shipping containers or drums.

  • Branch operations means any business operations of a branch captive insurance company in this State.

  • Mining Operations means obtaining or extracting any mineral by any mode or method or any purpose directly or indirectly connected therewith or incidental thereto, including—

  • Mining means the mining, extracting, producing, handling, milling or other processing of Products.

  • Supplier Operations means all assets, processes and systems (including information systems), data (including Customer data), personnel, and sites, used or processed by Supplier from time to time in the performance of this Agreement.

  • Projects means the projects identified in Exhibit A to the Agreement and all other projects, any costs of which are included in a Transitional Capital Plan pursuant to the Act or are Recovery Costs, and financed, by payment or reimbursement, with the proceeds of Bonds or Notes.

  • Commercial Operations Upon satisfaction of the following conditions, the Facility shall be considered to have achieved Commercial Operations on the Day specified in Seller's written notice described below: (i) the Acceptance Test has been passed, (ii) all generating units have passed Control System Acceptance Tests, (iii) the Transfer Date has occurred, (iv) Seller has (1) provided to Company the Required Models (as defined in Section 6(a) (Seller's Obligation to Provide Models) of Attachment B (Facility Owned by Seller)) in the form of Source Code, (2) placed the current version of the Source Code for the Required Models with the Source Code Escrow Agent as required in Section 6(b)(i)(A) (Establishment of Source Code Escrow) of Attachment B (Facility Owned by Seller), or (3) if Seller is unable to arrange for the placement of the appropriate Source Code into the Source Code Escrow account, placed the required funds with the Monetary Escrow Agent as required in Section 6(b)(ii)(A) (Establishment of Monetary Escrow) of Attachment B (Facility Owned by Seller), and (v) Seller provides Company with written notice that (aa) Seller is ready to declare the Commercial Operations Date and (bb) the Commercial Operations Date will occur within 24 hours (i.e., the next Day).

  • drilling means the act of boring a hole to reach a proposed bottom hole location through which oil or gas may be produced if encountered in paying quantities, and includes redrilling, sidetracking, deepening, or other means necessary to reach the proposed bottom hole location, testing, logging, plugging, and other operations necessary and incidental to the actual boring of the hole;

  • Exploration means all activities directed toward ascertaining the existence, location, quantity, quality or commercial value of deposits of Products.

  • Historic building means a building, including its structural components, that is located in this state and that is either individually listed on the national register of historic places under 16 U.S.C. 470a, located in a registered historic district, and certified by the state historic preservation officer as being of historic significance to the district, or is individually listed as an historic landmark designated by a local government certified under 16 U.S.C. 470a(c).

  • Casino means a casino as defined in section 1 of the KwaZulu-Natal Gaming and Betting Act, 2010 (Act No. 8 of 2010);

  • Petroleum Operations means, as the context may require, Exploration Operations, Development Operations or Production Operations or any combination of two or more of such operations, including construction, operation and maintenance of all necessary facilities, plugging and abandonment of Xxxxx, safety, environmental protection, transportation, storage, sale or disposition of Petroleum to the Delivery Point, Site Restoration and any or all other incidental operations or activities as may be necessary.

  • AREA OF OPERATIONS means the Company's oilfield operations in the States of Assam and Arunachal Pradesh.

  • Reservoir means a water impoundment project operated by the United States Army Corps of Engineers that is intended to retain water or delay the runoff of water in a designated surface area of land.

  • Joint Operations means all operations necessary or proper for the development, operation, protection and maintenance of the Joint Property.

  • Dewatering means the removal of water for construction activity. It can be a discharge of appropriated surface or groundwater to dry and/or solidify a construction site. It may require Minnesota Department of Natural Resources permits to be appropriated and if contaminated may require other MPCA permits to be discharged.

  • Commencement of Operations means the beginning of active operations by a qualifying business of the principal function for which a qualifying project was constructed.

  • Health Care Operations shall have the meaning given to such term under the HIPAA 2 Privacy Rule in 45 CFR § 164.501.

  • Development Operations means operations conducted in accordance with the Development Plan and shall include, but not be limited to the purchase, shipment or storage of equipment and materials used in developing Petroleum accumulations, the drilling, completion and testing of Development Xxxxx, the drilling and completion of Xxxxx for Gas or water injection, the laying of gathering lines, the installation of offshore platforms and installations, the installation of separators, tankages, pumps, artificial lift and other producing and injection facilities required to produce, process and transport Petroleum into main Oil storage or Gas processing facilities, either onshore or offshore, including the laying of pipelines within or outside the Contract Area, storage at Delivery Point(s), the installation of said storage or Gas processing facilities, the installation of export and loading facilities and other facilities required for the development and production of the said Petroleum accumulations and for the delivery of Crude Oil and/or Gas at the Delivery Point and also including incidental operations not specifically referred to herein but required for the most efficient and economic development and production of the said Petroleum accumulations in accordance with modern oilfield and petroleum industry practices.

  • Intermittent Resource means a Generation Capacity Resource with output that can vary as a function of its energy source, such as wind, solar, run of river hydroelectric power and other renewable resources.

  • Stormwater management planning area means the geographic area for which a stormwater management planning agency is authorized to prepare stormwater management plans, or a specific portion of that area identified in a stormwater management plan prepared by that agency.

  • Project means the goods or Services described in the Signature Document or a Work Order of this Contract.
