NEPA Determination means the Record of Decision for the Project issued by FTA on October 15, 2014 in accordance with NEPA, and which is supplemented by the US Fish and Wildlife Service determination letter dated October 7, 2016, and further supplemented by the environmental re-evaluation letter dated December 20, 2016.
NEPA Determination means (a) with respect to the Eligible Projects that are designated as of the Effective Date, the Finding of No Significant Impact issued by EPA on March 4, 2021 in accordance with NEPA and (b) with respect to any Additional Eligible Project or Replacement Eligible Project proposed by the Borrower pursuant to Section 14(q) (Affirmative Covenants – Additional and Replacement WIFIA Participant Loans), a Finding of No Significant Impact or other final environmental determination for such Replacement Eligible Project issued by EPA in accordance with NEPA at the time such Additional Eligible Project or Replacement Project is listed in Schedule II (WIFIA Participant Loans and Eligible Projects).
