Phase 2 Property. Lot Three (3)

Phase 2 Property means the approximately northern half of the Property that will be the site for the Phase 2 Minimum Improvements (generally depicted on Exhibit F-2) and for which Developer will create, for the GPLET Lease for Phase 2, a legal description concurrently with the approval of the civil plans for Phase 2 Minimum Improvements .

Phase 2 Property as used in this Lease is defined as that certain portion of the Land sold or transferred for Phase 2 to Tenant, Landlord, or an Affiliate of Landlord, as the case may be, as set forth on the Site Plan (defined below).

Examples of Phase 2 Property in a sentence

• Developer shall prepare and include in covenants, conditions, and restrictions running with the land for any residential property sold or rented a written disclosure that homes on the Phase 2 Property may be subject to noise and vibration from the active train operations on the Branch Line.

• The Lease, as amended by this Second Amendment and the exhibits (if any) hereto, contains all the representations and the entire understanding between the parties with respect to Building 2, the Phase 2 Property and the other subject matter of this Second Amendment.

• Except for previous agreements between the parties under Act 425 and any agreement with respect to fire protection, this Agreement supersedes and replaces all previous or contemporaneous, express or implied, written or oral statements, covenants, representations or agreements with respect to Phase 1 and Phase 2 Property and no oral statements or other prior or contemporaneous written material not specifically incorporated in this Agreement shall be of any effect.

• City shall accept the assignment of the Water-Related Utilities and the related Utilities Easements pursuant to the conditions of approval for the Phase 2 Property set forth in Tentative Tract Map 5520 (Heritage Valley Parks Specific Plan Phase 2) or shall cause a City District to accept the assignment.
