Product Marketing Employees means all management level employees of Respondent(s) who directly have participated (irrespective of the portion of working time involved) in the marketing, contracting, or promotion of the Product(s) in the United States within the eighteen (18) month period immediately prior to the Closing Date. These employees include, without limitation, all management level employees having any responsibilities in the areas of sales management, brand management, sales training, market research, managed care contracting, hospital market and other specialty markets, but excluding administrative
Product Marketing Employees means all management level employees of Respondent Inamed who have participated (irrespective of the portion of working time involved unless such participation consisted solely of oversight of accounting, tax or financial compliance) in the market research, marketing, contracting, or promotion of the Joint Development Botulinum Product(s) since the date of the Joint Development and Distribution Agreement. “Product Marketing Employees” shall include all such employees of Respondent Inamed that have received any documents or other communications that disclose with particularity Confidential Business Information.
Product Marketing Employees means salaried management level employees of Respondent(s) who directly have participated (irrespective of the portion of working time involved, unless such participation was a part of a broad executive management portfolio above the brand manager level, or of oversight of legal, accounting, tax or financial compliance) in the marketing, contracting, or promotion of the Divestiture Product(s) in the United States within the eighteen (18) month period immediately prior to the Closing Date. These employees include, without limitation, all management level employees having any responsibilities in the areas of sales management, brand management, sales training, market research, but excluding administrative assistants.

Examples of Product Marketing Employees in a sentence

  • In the case that any Munich Product Marketing Employees timely object against the transfer of their employment to German Purchaser in accordance with Section 613a (6) BGB, such employees (the “Objecting Employees”) will not be transferred by operation of law to German Purchaser, but will remain employed by Seller.

Product Marketing Employees means all management level employees of Respondent DSM or the DSM/BASF Alliance who directly participated (irrespective of the portion of working time involved) in the marketing, contracting, or promotion of the Feed Enzymes Product(s) within the eighteen (18) month period immediately prior to the Closing Date. These employees include, without limitation, all management level employees having any responsibilities in the areas of sales management, brand management, sales training, market research, but excluding administrative assistants; provided, however, the term “Product Marketing Employees” does not include those employees that the Commission-approved Acquirer expressly agrees to exclude.
