Project Delay definition

Project Delay has the meaning set out in Section 12.4 of this Schedule 2 [General Conditions];
Project Delay any circumstances outside of NetEDI’s control which are deemed likely to delay Project Completion. Proposal: means the document headed up as such.
Project Delay has the meaning set forth in Section 2.5.1

Examples of Project Delay in a sentence

  • To the knowledge of Borrower, there is no legislation, governmental regulation or judicial decision that could reasonably be expected to result in a Material Adverse Change, a Project Delay or a Cost Overrun.

  • There is no pending or, to the knowledge of the Borrower, threatened litigation, arbitration or governmental investigation, proceeding or inquiry by or against any Loan Party, or to the knowledge of the Borrower, any other Person, including, without limitation, any condemnation action, that could reasonably be expected to result in a Material Adverse Change, Project Delay or Cost Overrun.

  • There are no defaults by any Loan Party or, to the Borrower’s knowledge, any other default in existence under any Major Project Document, except where such default could not reasonably be expected to result in a Material Adverse Change, Project Delay or Cost Overrun.

  • Since the Closing Date, no event shall have occurred which Agent shall determine has resulted in, or could reasonably be expected to result in, a Material Adverse Change, a Project Delay or a Cost Overrun.

  • There exists no actual or, to the best of the Borrower’s knowledge, threatened termination, cancellation or limitation of, or any modification or change in, the business relationship of any Loan Party with any customer or group of customers of any Loan Party or any material supplier of goods or services to any Loan Party, in each case which could reasonably be expected to result in a Material Adverse Change, Project Delay or Cost Overrun.

  • Any Project Delay License shall expire upon the earlier of (i) HTG fully resuming its obligations and activities under Statement of Work No. 2, or (ii) expiration or earlier termination of Statement of Work No. 2.

  • The Borrower will not enter into any Change Order with respect to the Construction Contracts without the prior written consent of the Agent, unless the Borrower certifies, and the Independent Engineer confirms, that (i) such Change Order is technically feasible, and (ii) such Change Order could not reasonably be expected to result in a Material Adverse Change, a Project Delay, or a Cost Overrun.

  • The Borrower will, and will cause each of its Subsidiaries to, comply with all applicable Requirements of Law, except where the failure to do so could not reasonably be expected to result in a Material Adverse Change, Project Delay or Cost Overrun.

  • The Borrower will, and will cause each Subsidiary to, cause to be done at all times all things necessary to be duly qualified to do business and be in good standing as a foreign corporation in each jurisdiction where the failure to so qualify could reasonably be expected to result in a Material Adverse Change, Project Delay or Cost Overrun.

  • In the event of a Major Project Delay ([***]), the Development Advisory Committee shall revise the Clinical Development Plan and Development Budget pursuant to the Agreement and the Development Advisory Committee Charter.


More Definitions of Project Delay

Project Delay means a material delay to the timelines of the applicable Project Schedule. Such Project Delay will be discussed by the Joint Project Team and if required the JSC to agree upon the impact and potential appropriate remedial action.
Project Delay or "Project Delays" shall mean any delays in the commencement or completion of the Building Project which are due to delays in the performance of the Work at any Component of the Building Project arising from any act or omission of the Owner's Representative, the General Contractor, the CCIA or their respective agents, contractors or subcontractors engaged in the performance of the Work at the Building Project, or RURCBOG.
Project Delay means (i) the failure of the Project Construction Completion Requirements to be satisfied on or before the Project Construction Completion Deadline, and (ii) if a Major Replacement is undertaken by the Borrower, shall also include the failure of the Major Replacement Construction Completion Requirements to be satisfied on or before the Major Replacement Construction Completion Deadline.

Related to Project Delay

  • Tenant Delay means (i) any request by Tenant that Landlord delay in the commencement or completion of the Premises Base Building Work, or the Common Facilities Base Building Work, as applicable, for any reason; (ii) any delay in the Base Building Substantial Completion Date caused by Tenant’s contractors, agents and employee’s interference with Landlord and Landlord’s contractor’s, agents, and employees; or (iii) any other act or omission of Tenant or its officers, agents, servants or contractors which causes a delay in the Premises Base Building Work, or the Common Facilities Base Building Work, as applicable. If a delay shall occur in the Base Building Work as a result of Tenant Delay, then Tenant shall, within thirty (30) days after determination of the Rent Commencement Date, and only to the extent that such amount exceeds the rent credit, if any, due to Tenant, pay to Landlord for each day of Tenant’s Delay the amount of Basic Rent, Additional Rent and other charges that would have been payable hereunder had Tenant’s Delay not occurred to the extent that such Tenant Delay caused the Rent Commencement Date to be later than the date such date would have occurred had such Tenant Delay not occurred. Landlord shall give Tenant written notice of a Tenant Delay under clauses (ii) and (iii) above within twenty-four (24) hours after Landlord learns of such Tenant Delay. Subject to Tenant Delay and Force Majeure, if Landlord shall have failed to substantially complete the Premises Base Building Work on or before March 1, 2002, Tenant shall have the right to terminate the Lease by written notice to Landlord prior to March 15, 2002, whereupon this Lease shall terminate and be of no further force or effect thirty (30) days after the date of such notice unless Landlord shall have substantially completed the Premises Base Building Work prior to, or within such period.

  • Project Work means the work required to complete the Project.

  • Additional Work to mean additions or deletions or modifications to the amount, type or value of the Work and Services as required in this Contract, as directed and/or approved by the County.

  • Project Completion means completion of the Redevelopment in accordance with this Agreement to the state where the whole of the Morley Shopping Centre, as so redeveloped, is capable of occupation for its intended purpose;

  • DAY WORK means on item of work requiring the employment of labour with or without materials as the case may be, which, in the opinion of the Senior Engineer /Civil-in-charge, is not capable of being evaluated by the accepted methods of measurement or assessment and is paid for on the basis of the actual labour and materials utilised on the particular item of work referred to.

  • Project Completion Date means the date on which the Completion Certificate is issued;

  • Landlord Delay means any actual delay in the completion of the Improvements as a result of Landlord’s breach or material default under this Exhibit B, or Section 2.1 of the Lease; any failure to respond to any items required to be furnished or approved by Landlord within a time period expressly set forth in this Lease (unless a deemed approval is specified, in which case no Landlord Delay shall be assessed); Landlord’s failure to allow contractors access to the Building or Premises as scheduled or Landlord’s request for material changes in the final Plans and Specifications after Landlord’s approval thereof (unless such request was caused by an error or omission by Xxxxxx), provided, however, that notwithstanding the foregoing, no Landlord Delay shall be deemed to have occurred unless and until Tenant has delivered to Landlord a factually correct written notice (the “Landlord Delay Notice”), specifying the bona fide action or inaction which Tenant contends constitutes the Landlord Delay. If such action or inaction is not cured by Landlord within two (2) business days of Landlord’s receipt of such Landlord Delay Notice, then the Landlord Delay shall be deemed to have occurred as of the expiration of such two (2) business day period. A delay in construction of the Improvements due to a Tenant Delay, any Force Majeure event or a delay by any governmental authority (including but not limited to the City of Los Angeles) shall not be deemed a Landlord Delay.

  • Excusable Delay means a delay due to acts of God, governmental restrictions, stays, judgments, orders, decrees, enemy actions, civil commotion, fire, casualty, strikes, work stoppages, shortages of labor or materials or other causes beyond the reasonable control of Borrower, but lack of funds in and of itself shall not be deemed a cause beyond the control of Borrower.

  • Project Schedule means a document that, with respect to each Phase of the Project, identifies, coordinates and integrates the anticipated design and construction schedules, the Contracting Authority’s and Owner's responsibilities, government authority reviews and other activities as are necessary for the timely completion of the Work.

  • Building Work has the meaning given to it in section 6 of the Building and Construction Industry (Improving Productivity) Act 2016 (Cth);

  • Landlord’s Work means the work of constructing the Tenant Improvements.

  • Substantial Completion means the stage in the progress of the work as determined and certified by the Contracting Officer in writing to the Contractor, on which the work (or a portion designated by the Government) is sufficiently complete and satisfactory. Substantial completion means that the property may be occupied or used for the purpose for which it is intended, and only minor items such as touch-up, adjustments, and minor replacements or installations remain to be completed or corrected which:
