To ensure that competition is preserved during this time period, the Stipulation requires that the Court appoint a management trustee to serve as manager of the Radio Assets.
The management trustee will preserve the confidentiality of competitively sensitive marketing, pricing, and sales information; ensure defendants’ compliance with the Stipulation and the proposed Final Judgment; and maximize the value of the Radio Assets so as to permit expeditious divestiture in a manner consistent with the proposed Final Judgment.
Pursuant to Section IV of the proposed Final Judgment, the divestiture trustee will have the legal right to control the Radio Assets until they are sold to a final purchaser, subject to safeguards to prevent defendants from influencing their operation.
