Rejected Product definition

Rejected Product means batches of Product or Pipeline Product which are either (i) lost in production (or are not in compliance with the applicable Specifications, cGMPs, the FDCA and any other applicable Legal Requirements) as a result of the Generico Manufacturing or New Alpha Manufacturing or a failure or deficiency of the Generico Manufacturing or New Alpha Manufacturing, or (ii) determined by final decision of NEW ALPHA’s or GENERICO’s quality group not to be suitable for final release.
Rejected Product shall have the meaning set forth in SECTION 3.7. SPECIFICATIONS
Rejected Product shall have the meaning set forth in Section 5.2(a).

Examples of Rejected Product in a sentence

  • In addition to the provisions of Appendix B, Title and Risk of Loss, Product Substitution, and Rejected Product, Products returned or exchanged due to quality problems, duplicated shipments, outdated Product, incorrect Product shipped, Contractor errors otherwise not specified, or Products returned or exchanged due to Authorized User errors, shall be replaced with specified Products or the Authorized User shall be credited or refunded for the full purchase price.

  • School Buses delivered to an Authorized User in a condition that would be considered unacceptable to a reasonable person may be rejected (see also Appendix B §36 Rejected Product).

  • If Seller examines such Rejected Product to its satisfaction and determines that such damage or defect exists, and was not caused by the negligence, misuse, improper storage, or other accident of Buyer or any third party, then Seller shall replace such Rejected Product or issue a credit for the sales price of such Rejected Product.


More Definitions of Rejected Product

Rejected Product means any Products that either (i) failed functional or cosmetic testing during the integration process at Avnet and rejected by Nutanix or (ii) returned to Avnet as field failures by the End Customer pursuant to this Agreement.
