The Member Type code should be ‘E’ to indicate a non-reporting member.NOTE: When reporting a fractional share order route of less than one (1) share to the OATS system, the "Reporting Member" or its "Reporting Agent" should round the "Routed Shares Quantity" up to one (1) instead of down to zero (0); otherwise, the order event(s) will be rejected for invalid routed shares quantity.
Where the reporting is unilateral (where the counterparties to the Trade are entities incorporated overseas as per Clause F below( “Overseas Counterparties”) or are Clients of the Reporting Member), the details provided by the Reporting Member shall be deemed to be correct and shall be treated as matched in CCIL – TR.
Where necessary, the Ethics Committee shall, in carrying out this examination under paragraph 3, identify and assess if there are any specific and substantiated risks to the criteria in paragraph 3 arising from reports for which the Member acted as Reporting Member in the last two years of his or her mandate.
A decision can only be taken when the Reporting Member State has submitted the assessment report part I with a positive conclusion (or positive conclusion with conditions) as referred to in Art 8.2. However, an explicit confirmation of the part I conclusion by a Member Stated concerned (that is not the reporting MS) or a part II conclusion is not a requirement for a Member State decision (article 8(6)) to be positive.
In order to make a timely response by the sponsor feasible and to avoid unnecessary rejections of trial applications, the Reporting Member State (or MSC in case of part II) will formulate requests for information with clear and concise instructions to the sponsor on how to address the considerations stemming from the assessment.
