Service Provider Employee definition

Service Provider Employee means an employee of a Service Provider.
Service Provider Employee has the definition provided in the third paragraph of the General Terms and Conditions. Shipper Parties has the definition provided in General Terms and Conditions Section 12.10.
Service Provider Employee means any person employed or retained as an independent contractor by the Service Provider who provides Services to one or more of the Service Recipients or any of their Subsidiaries pursuant to this Agreement.

  • If any such person as is described in paragraph 7.3 of this Schedule is neither re-employed by the SERVICE PROVIDER or any Sub-Contractor nor dismissed by the CUSTOMER or replacement service provider within the time scales set out in this paragraph 7 of this Schedule, such person will be treated as a Transferring Service Provider Employee.

  • Service Provider acknowledges and agrees that all matters of compensation and benefits (including without limitation, pension plans, profit sharing plans, life insurance plans, medical plans, disability plans, severance plans, vacation or sickness arrangements, bonus or stock option arrangements, or any other compensation or incentive compensation arrangements) of any nature whatsoever for the Service Provider Employee is solely a matter between Service Provider and the Service Provider Employee.

  • The CUSTOMER and the SERVICE PROVIDER further agree that, as a result of the operation of TUPE, the contracts of employment between the Outgoing Service Provider and the Transferring Outgoing Service Provider Employees (except in relation to any contract terms relating to occupational pension schemes) will have effect from the Service Commencement Date as if originally made between the SERVICE PROVIDER and each such Transferring Outgoing Service Provider Employee.


More Definitions of Service Provider Employee

Service Provider Employee means any individual: (1) who is (a) duly licensed to practice medicine and (b) an employee or independent contractor of the Service Provider, including the physician shareholders of the Service Provider, or (2) who is (a) required by contract, law or regulatory authority to be employed by or whose services are required to be billed through a licensed physician for purposes of obtaining payment or reimbursement for such services or otherwise and (b) provides medical services to patients of the Service Provider, including, without limitation, nurse practitioners, certified registered nurse anesthetists, physician assistants, fellows, surgical assistants, certified nurse midwives, individuals with a masters degree in social work, physical therapists, psychologists, and any other similar individuals. Notwithstanding, anything contained herein to the contrary, the Service Provider may, at its discretion, retain other non-professional employees to provide other services to the Service Provider or its Service Provider Employees, provided that all expenses related to such non-professional employees shall constitute Service Provider Expenses and not Operational Expenses, and such non-professional employees shall not be considered "Service Provider Employees" for the purposes of this Agreement.

  • Service employee, means any person engaged in the performance of this contract other than any person employed in a bona fide executive, administrative, or professional capacity, as these terms are defined in Part 541 of Title 29, Code of Federal Regulations, as revised. It includes all such persons regardless of any contractual relationship that may be alleged to exist between a Contractor or subcontractor and such persons.

  • Company Service Provider means an employee, individual consultant, individual independent contractor, individual self-employed contractor, leased or temporary employee or director of the Company or any of its Subsidiaries.

  • Enhanced Service Provider (ESP) means the provider of enhanced services, as those services are defined in 47 CFR Section 64.702.

  • Retained Employee does not include any individual who has a direct or an indirect ownership interest of at least five percent (5%) in the profits, equity, capital, or value of the Taxpayer, or a child, grandchild, parent, or spouse, other than a spouse who is legally separated from the individual, of any individual who has direct or indirect ownership interest of at least five percent (5%) of the profits, equity, capital or value of the Company.
