Settled Defendant means: (i) Bank of America Corporation, Bank of America, N.A., Bank of America Canada, and Bank of America National Association; (ii) BNP Paribas Group, BNP Paribas North America Inc., BNP Paribas (Canada), and BNP Paribas; (iii) Citigroup, Inc., Citibank, N.A., Citibank Canada, and Citigroup Global Markets Canada Inc; (iv) The Xxxxxxx Xxxxx Group, Inc., Xxxxxxx, Xxxxx & Co., and Xxxxxxx Xxxxx Canada Inc.; (v) JPMorgan Chase & Co., X.X. Xxxxxx Bank Canada, X.X. Xxxxxx Canada, and JPMorgan Chase Bank National Association; (vi) UBS AG, UBS Securities LLC and UBS Bank (Canada); and (vii) any Defendant that executes its own settlement agreement before or after the execution of the Settlement Agreement, which settlement agreement is finally approved by the necessary Courts.

Xxxxxx Bank Canada, X.X. Xxxxxx Canada, and JPMorgan Chase Bank National Association, to the extent that the settlement agreement with such entities is finally approved by this Court; (v) UBS AG, UBS Securities LLC and UBS Bank (Canada), to the extent that the settlement agreement with such entities is finally approved by this Court; and (vi) any Defendant that executes its own settlement agreement after the execution of the Settlement Agreement, which settlement agreement is finally approved by the necessary Courts.

Settled Defendant s Claims” means all claims, demands, rights, remedies, liabilities, and causes of action of every nature and description whatsoever, whether based on federal, state, local, statutory, or common law, or any other law, rule, or regulation, including both known and Unknown Claims, that (i) have been or could have been asserted in the Litigation by any of the Defendants or the successors and assigns of any of them, against any of the Plaintiffs or any of their attorneys, and (ii) arise out of or relate in any way to the institution, prosecution, or Settlement of this Litigation or the Settled Claims, including but not limited to all claims for malicious prosecution or sanctions. “Settled Defendant’s Claims” does not include claims to enforce any of the terms of this Stipulation.

Settled Defendant s Claims” means any and all claims, rights, causes of action or liabilities, of every nature and description whatsoever, whether based in law or equity, on federal, state, local, statutory or common law or any other law, rule or regulation (including any claims for violations of Fed. R. Civ. P. 11), including both known claims and Unknown Claims, that have been or could have been asserted in the Action or any forum by the Released Parties, or any of them, or the successors and assigns of any of them against the Class Members or their attorneys, which arise out of or relate in any way to the institution, prosecution, or settlement of the Action (except for claims to enforce the Settlement).

Settled Defendant means any Defendant (excluding the Settling Defendant) that executes its own settlement agreement with the Plaintiff in the Proceeding and whose settlement agreement becomes effective in accordance with its terms, whether or not such settlement agreement is in existence at the Date of Execution.

Settled Defendant means Deutsche Lufthansa AG, Lufthansa Cargo AG, Swiss International Air Lines Ltd., Japan Airlines International Co., Ltd., Scandinavian Airlines System, Cargolux Airline International, Qantas Airways Limited, Singapore Airlines Ltd., Singapore Airlines Cargo PTE Ltd., Societe Air France, Koninklijke Luchtvaart Maatschuppij N.V. (KLM) and Martinair Holland N.V., and any other Defendant who has entered into a settlement agreement with the Plaintiffs relating to the allegations asserted in the Actions, whether or not such settlement agreement was in existence at the Execution Date.

Settled Defendant s Released Claims” means: all claims, debts, demands, liabilities, losses, matters, rights, suits and causes of action of any nature whatsoever, known or unknown, contingent or absolute, mature or immature, discoverable or undiscoverable, whether concealed or hidden, suspected or unsuspected, whether based in law or equity, arising under federal, state, common or foreign law, or any other law, rule or regulation, which now exist or heretofore have existed, that have been or could have been asserted in the Litigation or any forum by the Released Defendant Parties or any of them against Plaintiffs, Class Members, or Plaintiffs’ counsel, that arise out of or relate in any way to the institution, prosecution, or settlement of the claims against the Released Defendant Parties, provided, however, that this release shall not include any claims to enforce the Settlement.
