In January 2015, the Mineral Resources Department (“MRD”) of Fiji granted Special Mining Lease 62 (“SML 62”) on the Tuvatu project to the Company.
The Act converted the Special Mining Lease held by the Company to an Exploration Licence (EL1) for a period of two years from the date of the Transitional Act.
A memorandum of any such mortgages charges or other encumbrances shall thereupon by force of this Indenture and the ratifying Act be endorsed on the Special Exploration Licence or Special Mining Lease (as the case may be) in the order in which they appeared registered or recorded against an interest as aforesaid in any such surrendered tenement at the time of its surrender.
It is agreed by the parties that the area of the Municipality shall not include the lands the subject of SML1 and the State shall ensure that the lands the subject of SML1 or any other Special Mining Lease granted pursuant to this Indenture are not within the area of the Municipality or any other local authority.
